Default About to send prem letter please confirm

I have used the spreedsheet on the forum and my charges come to approx 3,000 my question is about the interest. am I right that you can only claim the interst charges if in the previous month you went overdrawn due to the bank charges they inforced on you, and not for going overdrawn because you spent to much.

I am ready to send my letter off, so would like this confirmed asap many thanks folks.

Thanks for your reply about the interest which I know is 8% but I am talking about the overdraft interest they charged me on my statements at the same time as overdraft usage and returned Direct Debt, my question still stands.

am I right that you can only claim the interst charges if in the previous month you went overdrawn due to the bank charges they inforced on you, and not for going overdrawn because you spent to much.

Yes, the 8% does'nt go on untill you file your court claim.

As for overdraft interest, personally I don't bother with it as its alot of work and in most cases does'nt add much value to the claim. Their is a spreadsheet in the templates library, but its quite complicated. You have to work out the interest that they charged you on top of each unlawful charge only - you CAN'T just claim the total overdraft interest. In other words, you can only claim the O/D interest that was levied as a result of an unlawful charge.

If it's a big claim or the charges were levied a long time ago then it might be worth it and you are intitled to re-claim it, so wether you want to try to work it out and claim it back or not is completely up to you.

Personally I would wait until the 14 days are up. You have said that you would give them 14 days, so it's best to stick to your word. However others have moved onto the next stage once receiving this letter and it hasn't made any difference.

Your choice really!

... or 16% ir even their own unauthorised borrowing rate of 29.8 and let them argue that it is unfair

if you download your statement and are reasonably proficient with excel, use the formula in the spreadsheet to work out how much they have been charging you. i have done it and it it is regularly over 20% as some of it is at 16 and some at the higher rate.

if you don't know how then i will try to talk you through it.

Hi I have the NI form here ready to fill out a bit scared really, but I have a question. My 6 years claiming is to the end of Jan this year, if can't get to the court before the end of the month, will I have to start the process of writing to the bank with a new amount owing missing out Jan charges in 2001

does anyone understand what I am saying.

hi are you doing this through mcol or your local court if you are doing it through your court , there is a template letter which you can print out and fill in all your details and then attach it to the n1 form hope this helps amy
