Question MyBruv v Lloyds

Hi all, I've been using the help on this forum for a while, but this is my first posting.

Situation so far (briefly).....

Applied to Lloyds TSB for my Bruv, £3,212.50
Had standard replys to which I replied.
Sent LBA
Got standard letter and £750 in bank.
Took as part payment only (used template letter)
Gave extra 10 days for settlement before going to court
Today.....filling in court form.

A couple(few) of questions:

I am sending in application for exemption (EX160) with the claim form as my brother receives Jobseekers.....so am I right in putting 'nil' in the court costs box on N1?

Am I right in sending 3 x claim forms, 2 x schedules + EX160. Is there anything else. Do I need to send proof of Jobseekers at this point? Do I need to include covering letter?

I hope my brother appreciates me!

I am fairly certain that the answer lays in the Step-by-Step guide in Wiki here

Best of luck

Oooohhhh! The more I read the more confused I become. I'm sorry, I have another question................

Lloyds paid £750 into my brothers account, I wrote and said no thanks, take it back etc.

Do I have to deduct this £750 from the court claim?

In some ways I wish I hadn't started this reclaiming business for my brother!

Hi
Yes deduct it from the Court claim, you need to put it as a minus figure on your spreadsheet.
Good luck, let us know how you get on.

Thanks Barty.......... I wish was possible to have saved the court forms as I now have to re-type it all, but at least I won't have submitted it incorrectly.

Still no aswer about whether I include court costs if my brother is claiming exemption.

This is scary stuff!

PS.......... Thanks Broke Dave. Fingers crossed, if this all goes through I might be lucky enough to get a packet of polo's from my ungrateful brother!!

Having 2nd thoughts. Should I go down the FOS route rather than the court? Can anyone give reasoning for either?

Personally I would go down the court route it really is not that tricky and LTSB are entirely predictable - have a good read around some of the success stories and you will find out how they work.

Also would help if you stuck to the one thread
