Unhappy CCJ on credit report - advice please.

First off I have been able to log onto my CallCredit credit report.

2 years ago I got some sort of form from Bryan Carter Solicitors I can't remember the name of the form. I had to send it back so I didn't go to court. I took it to my local CAB who said not to worry just fill it in and send and income and expendature form and that will be all sorted.

My OH kindly paid the £250 of the £650 asked for and we thought we had paid something to stop all problems.

Turns out it is a CCJ and I am very miffed because I got nothing from the Court to say this had happened and nothing from Bryan Carter to say this either. My OH paid before the court date as far as I recall and thus I have been led to a false end. If I'd have known I'd have got the CCJ anyway, I wouldn't have got him to pay. He will be furious when he finds out.

This has, effectively, got another 4 years left on my records and I feel conned.

Secondly, I have looked through these records and I am finding some records show I am paying when I'm not, some show defaults on accounts which have gone to debt collectors and I have found one that I don't recognise.

My Barclaycard Account has loads of OK payments on it from Feb last year to Feb this year. I have 4 defaults from Lowells for the Graduate account, T Mobile has defaults going back to 2002 and I haven't heard from them in years!

The one I am concerned about is King's Hill (No1) Ltd saying I owe £365 and I have been in default since May 2005 - I don't know who these people are.

I even have the smaller account with Lowells showing one default and one OK for Feb this year - I haven't paid them I'm CCAing them. What is all this about? I don't understand it all - all help greatfullt recieved, many thanks

Oh I'm just reading up about them and if the monies were paid within the month, the CCJ shouldn't even be there. Plus it's showing as active and not saticfied. So I have been sold a right lemon. Think I am going to phone a court for assistance.

Just adding because I wrote it wrongly - Bryan Carter claimed £250 and this was what we paid. The original debt was £650. So the full amount asked for was paid.

How much is the CCJ for?
Think you need to Subject Access Request Bryan CArter.

The CCJ was for £250. I have just been on to Northampton Bulk centre who said this should have been at least saticfied. My OH I'm sure did an electronic transfer within the 30 days but I just rang Bryan Carter for the Saticfaction Letter and ended up in a row as the woman told me it had been paid 3 days after the 30 day period. My OH is not so slap happy as to do that.

The cc would have had a £500 limit so effectively I could have this here for another 4 years over £100.

I'm actually feeling quite suicidal - it's only a 30 minute drive to Bryan Carters offices who are also chasing me for a debt from NatWest which is ALL bank charges.

I can't remember - my mother was nearly dying in hospital at the time. It could have been 28 days for all I know but he paid it as an electronic transfer.

I know he paid them the £250 requested.

The credit card had a limit of £500 so the extra £150 - making the balance £650 was charges. If I now were able to claim back those charges, I would have been given a CCJ for the poultry sum of £100 because £250 - £150 = £100.

I guess I could CAA them too but if this CCJ is on there for another 4 years because my OH's payment was 3 days late - I might apply to the court anyway under extreme circumstances because my mother was so ill at the time. Can't harm I suppose.
But why hadn't they sent me a form of saticfaction for 2yrs? Why did no one tell me I had a CCJ?

Just looking at my credit file online and it's showing that my limit on this card was £200.

If this is the case, I could well be owed money from this.

I think I will take your advice and Subject Access Request them. I am finding this very hard to deal with as getting a CCJ for just £250 is laughable. £2500 I could understand but £250? Evil swines.

How crap - sorry to hear that.

The Court in Northampton have said that if my OH paid on the day the time limit was up - that is then paid on time and not when the money clears with Bryan Carter - supposedly.

Bryan Carter said judgement was 18th August 05, and it had to be paid by 17th September 05 and "we actually got the money on 21st September 05".

So the court advised we get the absolute date my OH paid them and fax a copy to them and if it is within the time limit, make Bryan Carter agree this was paid within the time limit and get the CCJ removed.

I really don't understand what motivates these people to twist knives even further. When I spoke to Bryan Carter's today the silly bint on the phone starts picking on me - yet the debt is paid AND they didn't inform me for nearly 2yrs.
