| | Basic Account Customer | Re: Ccj Not Been Suspended Please Help Ive just been sent a ccj form from S C M too filled it in with some information-yes i do owe the money and gave a copy of income /expenditure and wrote a story to the effect that LLoyds gave me bad advice by telling me to let my accounts go to arrrears before they could help me out ( i approached them before i got into this situation for help!  ) and when i did they set the dogs on me!!
Anyway,
now i have a letter from SCM syaing they have requested the judgement be entered - will the court decide on what i have to pay even if its obvious i have no spare money and have cut back on everything?
LLoyds have an agreement with my wife to pay £1 pm temp, i have another account also defaulted and have offered £1 pm temp, but have heard nothing from them- i sent £1 back with offer letter, what will happen if they tell me to pay an amount i cant pay? can they make you bancrupt or sell your house for the debt?? if house joint owned can they make you sell?? can i appeal against it ?
can i go to the judgement and give my side??

In December i realised that i had been paying Allied International Credit (AIC) £100 per month as per the agreement, i contacted AIC who said payments had all been made and all on time but they had been a bit slow sending them to SCM, so i contacted SCM and told them payments had all been made and judgement was illegal, they agreed that payments had been made and refunded me the court costs and said they would get the judgement suspended (obviously did not want to pay £35 to get it removed!).
I received my experian file last week only to see the judgement still there.
Can anbody let me know where i stand on this as i feel they have acted illegally but dont know what road to pursue it down.

it's almost certain your interest has been frozen and so long as you keep up with the instalments they will not be able to use any further enforcements.

, its what i offered in the first place as a temp measure till i could sort things out, now they can have £1pm for as long as it takes to clear £8000 !! Only downside is i now have a CCJ  | I bet the judge loved doing this one..Pay back time to the banks me thinks...I know it's bad you have CCJ (not laughing about that at all) I just think it's very funny that judge has had a chance at some payback to these banks.... |
