Yep - £60 fecking quid!!! In one month they sent me this same letter three times and then charged me £60 commission that month three times. Yes the maths makes me sick! The wages I made that month was less than a 1/3 of these charges.

This is why I am so poor! I am a mother of 2 who at the time was studying for a degree and trying to hold down a part-time job!

Oh forgot to add that they took away my overdraft and were charging £5 per day for every day that I was overdrawn (which was every day of the month). So in a month I would rack up on average around £160 per month for the daily charge and then another £100 or so, for the direct debits they bounced that month too, plus the unauthorised o/d fee of around £15.

Unfortunately for me, I have not filed my electronic statements for Smile, as throughtly as I have done for paper statements for other banks. I have had to Subject Access Request them in the last week. However, from what I have filed, they owe me around £1.3k!

Don't worry my deedee1310 v Smile thread will be starting as soon as I have all my statements in my hot little hand!

It makes me so angry! However if had not been for the fact that I am currently writing my dissertation of debt and it's causes, I would not have found this site! I've known about the OFT ruling and people claiming money back, for a while but was scared to lose my bank accounts as my credit rating is pants so I can't open another account at the moment. I have more than one bank account but seeing as I will at some point taking them all to task regarding charges, I may be left with nothing banking-wise. The plus side is that I will be debt-free (except for Student Loan and mortgage).

This site has galvanised me into action, so I am spreading the CAG gospel to all my friends and family.

Ok, from what i see you sent your Subject Access Request 27th March, and your non compliance 23rd May.
So now you can file at court to get the rest of your information as they have only supplied you with partial documents.

To file at court after you sent the non compliance will cost roughly £63, but this is reclaimable.
