Default Phoenix Recoveries/Charging order-help please

can anyone help? urgent
i have received a court paper stating that pheonix are taking me to court for a charging order on my home i have no idea what this debt is for how can i find out please help if possible

Hiya Spike and welcome to CAG. There are plenty of people here to help you. Would it be possible for you to post up what they say in the particulars of claim. Do not post up any personal details though.

Also, you could do a check on your credit file in order to see if they show up there. This can be done with either with Experian or Equifax. This way you could possibly match the debt with what they are claiming

Hi Jowalshy,

This debt originated from a Visa with HSBC. We got into financial difficulty 3 years ago - signed up with a debt agency and have been paying a monthly payment ever since. Then suddenly we get this 'charging order' against our property - with a court hearing on 3rd September 2008. We spoke to the solicitors for Marlin and they agreed we had an agreement with HSBC for a Visa and that they have transferred our debt to a 'loan agreement'. Our debt agency seem to be very relaxed about this whole issue - but I am worried that they can take my home from me. We tried odjecting to the charging order - but lost. Can you let us know what this means now?
