Hello again, have just filed for judgement myself today, they had until yetserday to file a defence.

Its dead easy to do, just clcik on the 'start' button on mcol - fill in how you would like to be payed (i've put the immediately option) and work out how much more in interest your due since you filed your claim and fill that in the box provided.

Just hope the courts dont let them file a defence now that their time is up!!!

cant see any reason why you wouldnt want to file for judgement, i filed yesterday and its been accepted today, the order has now been sent to I.F and fingers crossed, must be only a week or so till i get the cash!!

I've filed too..am waiting for some action!!! It seems to be such a long and drawn out process but here's hoping we all get our money back...Im on to Halifax now too (I know in retrospect I should have combined the two but didnt realise, so am doing it separately!). Agree re this forum being quiet...are all those IF customers happy not to claim???

You should get a letter any day now settling in full.... I did today!!

£1800 Settled in full!! Only problem is, they said they would credit my account.. its been closed for 2 years though. I rang them and they are sending out a cheque asap!!

Dont worry, you'll get yours by the end of the week i would guess.

winner, i checked mcol and it said judgement accepted, i emailed the person at hbos who wrote the letter and they said they would see what was happening, but all that was 3-4 days ago and nothing since.

well, 8 days since judgement was accepted, in that time i have had a phonecall from hbos saying i claimed for the wrong amount thats why they havent settled. i pointed out that their client supplied the list of charges so how could it be wrong? he agreed then that they would settle and would call me back that day to tell me how i would be paid. that was 5 days ago and nothing since, so i've sent an email saying that if i dont hear by the end of the day i will file for a warrant.

Good for you whitemouse. Honestly, I always end up getting some jobsworth who doesnt understand (or pretends not to!). I have had another delay with the small claims court asking for clarification of who I am filing a claim against - they worded it really peculiarly using some strange example, but basically wanted to know was it "X trading as Y" or "X a firm sued as a firm" or "X Limited" or "X PLC". I said I couldnt find anything on IFs website that refer to them as anything other than Intelligent Finance, but that on one of the customer service pages it refers to them as a subsidiary of Halifax Plc. SO I have suggested it must be "Halifax Plc trading as Intelligent Finance" and given the Halifax address. I hope this is right! Cant be doing with any more delays, although thankfully the NI Small Claims system is online and I can access correspondence that has been issued to me before I receive it in the post, especially useful since they are insisting on posting everything second class!

How's it going Whitemouse? I finally heard today that the NI court has served the case...IF have until 1st March to respond...could be an anxious month ahead! Meanwhile today I received "correspondence" from Halifax (who I am moving on to next!) - 35 envelopes of statements arrived in one go today - I could hardly get the front door open...a really efficient and cost effective way of providing me with info - NOT!!!!!!! Ah well...lots of reading ahead tonight, and the pink highlighter is going to be working overtime on those statements!!!

Keep at them whitemouse, dont give up. I have read your thread with interest. I will be going after IF in the ext few days. I wont need an S.A.R - (Subject Access Request) letter, as I have all my IF statements from the day I opened my account (how sad is that!). So I will be starting at the letter for money stage.

Anyway I will be keeping an eye out for your thread.

i spoke to them yesterday, they said as far as they were concerned the cheque had been posted 2 weeks ago, however the person responsible for posting was off until monday 5th so they couldnt confirm. i will call back monday, if there is no satisfactory conclusion i will file for warrant that day, i was just waiting for payday really, so final chance
