car insurance claim

I was hit by another car in a car park in November and submitted a claim.
In brief after months of waiting my insurers stated the third party's insurers said that in the abscence of witnesses they would settle on a 55/50 basis. I reluctantly agreed. I then received notice that the offer had been withdrawn and my insurers want me to fill in a form for a solicitor to take court action which I do not wish to do. As I am now insured with another company and have paid £150 excess and lost some of my no claims bonus. What is my status if I tell my insurers not to proceed. Will there be any comeback? or will that be the end of the matter?

Let me get this straight

You were hit by another car, you paid your excess, you have lost some of your no claims bonus and you are unwilling to go to Court to recover what you have lost or to assist your insurers in recovering what they have spent on repairing your car.

What aren't you telling us?

Do you mean that the other insurer is taking you to court - i.e, holding you fully liable or that a further claim has been made (injuries)? If they have made an offer and paid out, then, imho, they cannot go back on it.

The reason I was reluctant to go to court was that I thought the the action would be against me personally and not my insurers , also having payed an excess I thought that this was not retrievable.
After speaking again to my insurers (different person this time!) I find that this is not the case and I could get some recompense.

I am now going to go to court to try to acheive this.
