Default Insurance Company Trying To Frustrate My Claim!!!!

I do not know how the FOS works, do they make insurance companies pay out? If so is there any reason why I couldn't just fill out an N1 and take them to court? MY claim started in February and it is taking sooo long?

Also can I claim for costs of all the unnessessary letters? These guys said because my money was in a bag I was wearing it was not on my possession!!!

Dear xxx,

I do not feel you are being reasonable.

My original complaint in February was not received by Europe Assist. I resent this claim recorded delivery and it took several letters and telephone calls to finally receive a response.

Despite the fact that I had clearly stated on my claim that the money was on my person, when you finally responded to my claim on 9/6/08 you did not settle in full because “the money must be on my person”. This was a completely false statement with no reasoning or supporting evidence.

After subsequent correspondence on the15/7/08 you then stated that you require further evidence of the withdrawal, despite the fact that I had provided a signed, written statement from my father confirming my claim.

After providing my father’s bank statement and following my conversation with X on the 2nd September I was assured that you would respond in writing the following week. I called today and spoke to Y who informs me that you have still not responded which is very disappointing.

To any normal person these actions are suggestive of an unlawful attempt to frustrate my claim.

Please ensure that I have the response next week that Morris today said he would attempt to arrange. If I do not received a clear response in relation to all items including the bag, wallet and money that was on my possession within 14 days I will escalate my complaint to the FOS. I will also hold you liable for my costs should I decide to take further action in relation to your unreasonable behavior.

You can go to court but they may ask why you didnt use the FOS, a form of Alternative Dispute Resolution. The FOS decision is binding on insurers but not on you and is also free of charge (the insurer pays a flat fee which no doubt they increase premiums across the board to cover for but that's another discussion).

I would use the FOS. If the insurer has not sent a final response to a complaint or has not complied with the FOS requirements (such as missing deadlines or not providing a reason why they need to extend the deadline (which they can do)) then you can go straight to the FOS.

Thanks for this I has a look at it and it appears that they award compensation for "inconvenience".
