Default patch -v- First Direct : ** WON **

Hi All,
Just got my 6 years of statements today. Sent Data Protection Act on 08/04/06.
Works out to £3414.00 in owed charges. I will be posting the Request for repayment of charges tomorrow 17/05/06.
Just to clarify, the 14 days starts 2 days from posting the letter, meaning I would send the LBC on 02/06/06 ?
I hope this hasn’t been answered somewhere ells. I’m new to forums so feel free to help, guide, berate and bully me till I get it right.

You doin OK. 14 days starts from when they could reasonably be believed to have received the letter. Two days is reasonable... so yes, that's fine.

Cheers Tom,

There are 2 CHARGE RECALL S/O - D/D in the last year for £37.50 each. I did'nt add them as my account was overdrawn due to late arivals of monies not overdraft charges. Does that sound fair?

No worries.
Don't forget the items on the statements that say 'OD Fee' are for exceeding ur OD limit and 'XS OD Fee' is for every time another payment (DD,SO) bounces.
They are both unfair etc and therefore yours. You cannot claim for OD arrangement fee or similar wording - these are 'services'.

I'm going to be filing my Claim against FD on Friday... after the postman's been. It seems FD like to let the claim go ahead if it's more than £500 - apparently "testing the resolve" of the claimant. You've had the absolute standard replies so far; no doubt you'll have one next from Marcus Grolby telling you some other blah, offering you the Financial Ombudsman's Service, etc etc blah blah...

Just ensure you stick to your timetable and you should be fine.

Times up on the LBA.
I'm on the moneyclaim website filling in the form.
I seem to remember some one having a problem with the Organisation's Name!
I have entered First Direct Bank. Should it be First Direct PLC?
I can't find the thread that mentioned this

Any help greatly appreciated.
