If you could find them that would be great. Although if they have only just issued they may not have been affected yet.

If you come across any others if you could direct them to this thread which is stickied in the general forum:

Hull County Court Strike out orders - UPDATE and it's GOOD news!

Also if you could encourage them to to contact me or Bankfodder. If our pms are full then e-mail evidence@consumeractiongr oup.co.uk and leave contact details.

Thanks

this is probably the most important thing i am writing on this thread so please read it: WHEN THE COURT SEND YOU THE DIRECTIONS (WHAT NEEDS DOING), IF YOU WANT US TO HELP - PUT THE FULL DIRECTIONS ON YOUR THREAD SO WE CAN READ AND ADVISE IMMEDIATELY! it's no good telling us you've missed a date - we don't do miracles! we can help but we have to know what is required.

just dusting this thread off as a few more seem to be getting questionaires again.

here is how to fill it out - - - -(including the draft order for directions) - - - - other info in post 1 of this thread.

aq info:
Allocation Questionnaires - A guide to completion
this is your step by step completion guide -and here is:New strategy for Allocation Questionaires
and here is how to use it:
for section g of the n149 (section h on the n150), use the wording in blue on post #3 of new strategy link, and then attach draft order for directions - use wording on post #2 of new strategy link(the bit in blue) making sure to add your name and court claim number to all pages. simple as that. just follow the steps with these two minor additions. the draft order is just asking the judge to order both parties to lay out their wares within 14 days of him ordering it - so it shortens the length of the time to a court date - and as dg/hsbc/all banks don't want to do it - they will pay up by offer or just not file their aq in which case you also win.

on, the other front - of this two pronged thing - have you sent dg a breakdown of your charges - it is advisable to do that, as they always ask for one before they offer anything - so it saves a couple of days.

in theory you should receive a copy of their defence along with the transfer to your local court (that's if you did mcol) - if you did the n1 then it should be rolling along anytime after the 28 days is up and they have filed their defence -
whichever of these - if you think you should have had it by now - ring the court and ask when it will be sent to you - with all the claims - they are probably bound to bodge up now and again.

The deadline for filing the AQ in my case is today, i rang the court but they said i need to phone back later in the week, once their post is up to date, to see if HSBC have sent in theirs. Does anyone know what approach are DG taking at this stage?

Hi Lattie
In response to your post I did the MCOL and have received my AQ to be sent in by 17th JUly - but no attachment of defence from DG? Thats what is puzzling me - how do I know what there defence will consist of?

it's standard - it must be in this forum about 1000 times - it's always the same -
just do the aq and get it in by the 17th - use that post 286 above for how to fill it out.
you could ring the court and ask about getting a copy of their defence - with so many claims a few are bound to get waylaid

okay - AQ completed except for few little bits I need guidance on?
1]On the "expert evidence bit" won't the "evidence" we will be using in our court bundle be classed as this?
2]Section F proposed directions...ticked yes enclosed list of directions but what do I tick for "have they been agreed with the other parties" ? yes or no?
3]H what do I tick for - "do u intend to make any applications in the immediate future" ?

Any help - just a few niggles that's all !!
At what point do I include the 250.00 MCOL and £100 Allocation fee?

Hi

I filed my AQ last week and asked similar questions:

1) No expert evidence
2) Directions haven't been agreed, tick no
3) No to intending to make any applications in the immediate future

Hope this helps! Lets hope we get our money back soon

Good luck with your claim!
