i just wrote to inform them that the court have recieved mine and that it will mean an extra 100 quid on my claim. the said about settling. did they settle yours after your letter lateralus?

mine/actually my son's, was about 6 months ago now - before the avalanche of claims and they were routinely making an offer just before the 28 days expired then - here's my son's claim - short and sweet - as i never went onto the forum until they had offered.....

Hi

I have been told that the allocation questionaire on both of my cases has been dispensed with but the judge at my local court has now transferred my case to The Civil Justices Centre at Cardiff!

I am not sure why this has happened and wondered if this had happened to anyone else! Should I instruct a solicitor to come with me when (and if) I get my hearing date?

Just a note to let you all know!

I just rang my local court to try and find out why my case had been transferred. She said all cases are now being transferred until the test case has been heard! All cases are being stayed until after that date. Does anyone know what that means please? I dont think it sounds to good! Typical the banks are fighting back now that I have paid my court fees!!

Yes I think I will asks the mods as I have not heard anything about this either! Rang the civil Justices court and apparently I am one of about 100 people attending a hearing on the 14th August!!! My god wont be able to bear it that long! Hope they make an offer!!!

ok, ok, we'll find out what's what - but in the meantime - can you please, please remember that the primary goal and the best outcome is an offer from dg and to that end - send them a nudge letter with a breakdown (one every 10 days). dg will offer - it won't go to a test case - all the cases will get offers before it gets there - so, to help yourselves along - go back to post 1 on this thread and write a nudge.

Thanks Lateralus, I sent DG a nudge letter end of last week. I'll give them until the middle of next week and send another! I did panic after speaking to the courts but on reading some of the other threads have calmed down a little (may have been the half bottle of red wine)!!

I am writing you today in a further effort to ask you to consider my claim. I am most disappointed that you have not acknowledged my previous correspondence.


I have filed my claim on xx/xx/xx. I have filed my Allocation Questionnaire on xx/xx/xx. I have written to you in the past, asking for you to consider my claim and reply to me. I have heard nothing. Were this to come before a judge, it is obvious who is making any and all attempts at resolution.
It is my feeling that you seem to have no intention of defending this claim in court and are simply procrastinating.


I am mindful of the vast number of claims with which you are currently dealing. In order to more speedily resolve this matter, I am willing to accept the sum of £xxxx. (rounded down to nearest pound and including your total claim including aq fee ). (Plus daily rate if applicable and you included it in your claim. Ie. accept the sum of £xxxx plus £x.xx per day from the date I filed the claim until the date it is resolved) I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality.

Please find enclosed another copy of my schedule of charges relating to this claim.

a note here peeps - i'm just doing this off the top of my head and with absolutely no legal background - feel free to use some personal details/thoughts in these letters - - it isn't meant to be a template -- use the phrases you've picked up from court letters, other posts, etc.
you can always run it by the forum to see what peeps think if in doubt.
i'd encourage a little freedom of expression so they aren't looking at exactly the same thing all day.
