Default Revenge is sweet v HSBC

I have read in various internet forums that HSBC tend to make an offer at some point - am I the exception to the rule ??

I submitted MCOL claim 5th Feb having had minimal communication with them despite letters to them and emails to their internet email address.

I have had a notice of an Acknowledgement of Service being filed by HSBC saying they intend to defend all of the claim. I presume this is bluff and I will get a low offer at some point, which I will turn down.

According to my paperwork, they have 28 days from 10th Feb to file a defence. Are they likely to do this or should I get an offer in the meantime ?

Any help would be appreciated.

The bank will almost certainly offer to settle before court. Sometimes early in the process, sometimes right at the last moment.
Unforunately I can't comment too much on your claim as you have not posted any history of your claim.
Start your own thread in the HSBC Bank forum and if you have any questions, post them there.

Potted history of my case against HSBC so far......

12th december - initial letter to HSBC requesting statements.......ignored by the Bank although cheque was cashed on 13th !!

6th January - reminder letter to HSBC about statements...reply from HSBC saying they were on their way (they arrived with a day or so to spare)

21st January - letter to HSBC requesting refund of charges (£1,851) plus interest (£232.87) giving them 7 days to respond and advising them that as I had not had the full 6 years of statements, I required the missing one .........ignored by the Bank

27th January - second letter to HSBC with updated interest figure (£235.17) and advising them that in 7 days I would commence court action and would report them to the Information Commissioner re the missing bank statement. - letter from HSBC (the famous Colin Langdale, Senior Service Quality Officer) saying they were investigating.

31st January - e-mail to Colin Langdale confirming that I would still be commencing court action and would report them to Information Commissioner. Requested e-mail back to me by the end of the day confirming they had received my e-mail......ignored by the Bank. Sent a follow-up email to them the same day asking again for an e-mail back confirming receipt of my original e-mail........ignored by the bank

1st February - e-mailed service quality dept at HSBC again requesting that they confirm that they have received my initial e-mail....ignored by the bank

2nd February - received 2 e-mails from HSBC saying that my correspondence had been "forwarded to the area concerned"

3rd February - submitted claim on MCOL

4th February - Reported HSBC to the Information Commissioner online

5th February - further e-mail from Service Quality at HSBC confirming receipt of one of the e-mails I had sent previously.

5th February - had papers from Northampton County Court saying that the claim will be deemed to be served on 10th Feb.

6th February - HSBC filed an Acknowledgement of Service saying they intend to defend all of the claim - they have 28 days from 10th to file a defence (this is the first time they have done anything quickly since I started this)

9th February - e-mail from Information Commissioners saying that my complaint against HSBC has been assigned to a casework team.

Can anyone estimate how much longer HSBC will drag this one out ? I want to get it settled, yet would love to send the bailliffs in !!

ok revenge, i can see that you started this procedure probably using moneyexpert or bbc for a couple of reasons - the 7 days you gave them instead of 14 and the interest included before the claim stage which we also don't advise. and plus your join date is feb (a real sherlock holmes, me! d'oh) anyway, welcome to CAG and welcome to the forum. our advice at this point - when you receive your acknowledgment - look on page 2 - you will see dg solicitors, possibly a name and for sure an address. you should now send 2 copies of your breakdown of charges (which is hopefully is a neatly done list format - spreadsheet style) with dates and names of each charge... send 2 copies to the court - address on paperwork and asking them to attach these to your claim (give them the claim number), and to dg solicitors - send one copy and also reference it to your claim. DG never sends an offer but that they first ask for this list - so, you are just sending it at this point to save those extra couple of days down the line - whenever they decide to pick up your file and deal with it. as you say, they now have until 28 days from the date of service (issue), so, nearer then - keep your eye on the judgment button on mcol.
from this point(today) - it is not uncommon to receive an offer from the bank - that is in answer to one of your earlier letters and will be less than you are now asking for as you have now added on interest and court fee. unless by some fluke it were a decent offer and you wanted to accept it - just follow the rejecting offers link and hold tight for an offer from dg. as rooster says, it could come before they file their defense, or it could come before the allocation questionaire (next stage) is due (that paperwork would come to you automatically at the end of the 28 days if they file a defense which they usually do) they do anything to stall in most cases - pushing back and pushing it back - i think they are hoping people just give up. but keep with it - my estimation for you - on average - i'd say you are looking at about 6 weeks to your money - obviously that is only a very rough guess - but if you are looking for a rough guess - based on lots of cases - that's it. good luck - get back if you have questions or need reassurance - lots and lots have been where you are now - and lots and lots are happy with their returned money!

don't get disheartened revenge, i think other sites on this topic sometimes offer promises of easy money. unfortunately, if you are serious about these things, they take time - maybe a little longer than you'd hoped, but by taking your time and sticking to your timetable, at least you get a better understanding of what you are hoping to achieve, without too many nasty surprises. stick with it - you will get your rewards soon
