Default Me vs HSBC.....My diary to completion

Here's my bit of encouragement to all you guys thinking about going for it...
My claim for £1318.46 went as follows :-

1st September Requested statements via data protection act
4th September Re-sent letter with £10 fee I forgot to put in 1st
time (Doh!)
23rd September Prelim. letter hand delivered to my branch.
2nd October Acknowledgement received of prelim. Letter
9th October 14 days up.
10th October LBA sent.
16th October Copy LBA sent to new address requested
1st November 06 14 days up & claim issued via money claim online
6th November 06 Bank requests for 28 days to defend claim
10th November 06 Offer of £1000 to go away (+£10 fee returned)
13th November 06 Replied “no, thanks” to offer.
27th November 06 Filed defence (AAAAAAAAGH!)
30th November 06 Offered full amount…+8% interest +£120 fees

What a waste - had to pay out £1700 odd when they could of settled for 75% of that....

Also asked me to sign a non-disclosure marked "without prejudice"...Kinda defeats the object of asking me to sign it methinks.....

A BIG thanks to all the guys at CAG for the templates & guides and a REAL big help......

My advice to others is GO FOR IT - But read carefully (and I mean read, not skim) the guides and advice here BEFORE you get stuck in.

glad all went ok harvey can i ask something...you originally had claim of 1318 pus cost 120 =1438 so did the 8% take you to 1700? just seems alot of interst?

£1318 + interest equalled £1628 + £120 costs = £1748...
I used schedule of charges claim form posted here.
If its wrong - I ain't complaining and they didn't argue...

Without Prejudice means that those documents 'cannot be used as evidence in a court' in case you decided to take things further in a court and press for action based on their request that they want it 'hushed up'

You interest seems about right, £310 on a charge value of £1318 - Pharma rep why did you think that was a lot ??

Can someone please tell me where to get a schedule of charges spreadsheet template from. I am handing my aq in to court today and also I only have 1 years statement, what do I do about the other 5 years on the schedule?

have you not put all your charges onto a spreadsheet yet??

ok... here's a template, but you better get this done straight away. the court and hsbc's solicitors will want this before they will look at your claim.

I'm afraid I don'd know how to get a thread. I am not good with computers which is why I hadn't put my charges on to a spreadsheet. I was told that I could estimate my charges by multiplying the 2 years statements i had by 3. Which is what I have done from the start of this whole process. Anyway I didnot recieve with barclays defence from the court an allocation questionaire, when I rang Northamptons court helpline the man said sorry and said he would send me 1. I said don't worry I will pick 1 up when I take my statements and schedule. My local court is Canterbury, Kent and when I got there and asked for an AQ I was informed that they are not using AQ's anymore because of the amount of claims against banks they are just getting the judge to look at the original claim form and deciding from that whether its worth a hearing. Do you think this will have an adverse affect on my claim?

99% of the time HSBC doesn't close an account after the first claim but often do on the second.

Hello Just joined up with you today.My case against Barclays has just been transferred to my local County Court!I'm feeling abit nervous now.Have just spoken to the court who say allocation questionnaire not needed and case should be heard in June. Anyone got any advice/thoughts on this?

malthouse - welcome to the site - you would be well served with loads of advice if you start your own thread in the barclays forum - just press this:Barclays Bank

and look for this:
press it - give it a title and away you go - you'll be in the right place to get info for your bank.
