Default Posted my letter yesterday

Hi, just wanted to say that I posted my letter yesterday, claiming £490 in charges from the last year. I haven't claimed for debit interest and all these charges are purely overdraft fees. (mainly overdrawn because the bank carried on taking my mortgage for 3 months without me knowing about it :/).

Will keep you all posted, I presume I should just persevere and hopefully I should get somewhere. I also have another bank account up and running in case they get nasty.

Hopefully I wil get good news anyway

Well its 14 days tomorrow, and I haven't heard a peep

I sent it to the Canada square address as my account holding branch is a tiny room in a supermarket and I don't think it is open very often.

Should I resend the first letter to my account holding branch, or just carry on with the next letter now?

Ooh, in the nick of time, I have a reply. They have offered me £275 with the standard letter.

I shall be sending the LBA then :o

They replied much quicker this time and basically told me to go away.

Says the bank does not agree that the charges are unlawful, accepts that the letter will not provide the response I hoped for, but trusts he has been able to clarify the banks position.

I sent the second letter in the templates file so shall I now just go ahead and wait for the 14 days to be up, then file the moneyclaim thing? Or can I do the moneyclaim thing now?

Also, has anyone actually been to court and lost a claim?? I have read the FAQs and accept I might have to go to court, but how certain is it that I will win?

THanks for any advice
