Default Un1boy's Credit card claim - SETTLED!

Well I have just been offered a full settlement of £600.27 for m current account.

I worked out my credit card charges after byt they owe me £45 - yes, £45!!!

I sent the prelim but the deadline was up last thursday. They have had over a week and I assumed that as it's a small amount they'd just refund it. I called them laods and they said the CC people are looking into it. I'm tired of being nice to them now, so sent the LBA. they;ve got 14 days now otherwise I'm entering another MCOL - makes me laugh, I've just successfully got a settlement out of them, do they think I'd back down over £45?

doesn't make sense does it. they sent me an offer of almost £4,000 but bounced a d/d for £37.00 and charged me £30 on the same day

I know, they're so stupid - I bet this'll end up in court and they'll end up paying about £80.00 to me. They should realise I've just ahd a settlemetn for my current account so won't back down.

Well, still not heard anything from them - they didn't even bother to reply to my prelim. Ah well, bet they don't pay up and it goes to court - they'll end up paying out about 70/80 pounds of they don't.

You see HSBC's credit card department run seperately to their other departments, so I bet they won't even realise that I hve successfully claimed on my current account. I guess it's a good savings technique tho, eh?!

Just an update - received a letter today from HSBC credit card department in respoinse to my LBS for £45 in charges. They are sending me a chewque for hte full amount! The deadline was 17.08.2006 and seeing as they didn't even reply to my Prelim I'm surprised it was so quick. They did say though that my branch have only just forwarded the letters on and gave me an address to send all future CC corresopondence to. I will post that address as soon as I have the letter at a pc!

Should I reply and say great thanks, but I want the cheque within, say seven days? Or just leave it now and wait?

Any ideas?

Ok, had a call from someone Friday and he has put my cheque in the post!!!

So, make sure you go for ANY amounts guys!!

Right, I have received the letter with the cheque in it today. It's from some guy in the Credit Card department, saying they have refunded it as a gesture of goodwill because they messed my addresses up and were sending info to my mum and dad's address when I asked them to change it to my address. He has also asked that this means I never ask for HSBC to refund charges again, nor take any legal action against them again. He says if he doesn't here from me within 8 weeks, he'll assume the matter is closed. Also says that it is of course without prejudice. Hmmm....well, I don't care what he tries to say the reason is and I will reply (after cashing the cheque and it's cleared!) saying that I do accept the refund, however without any conditions - I will also politely point out that it is a criminal offence under the Human Rights Act to restrict someone's right to take legal action against someone else, and if HSBC or any of their representatives ever send me a letter with a clause like that in it I will take it further.

Ah well, I have my money back now - so please, please do go after EVERYTHING- no matter how little!

Will change my thread name and donate as soon as it clears!

lol, not in terms of settlements, no!

I'm just so fed up with all these companies wanting the last word - I mean the way I name is spelt can be the girl's way, however all of my letters are signed with (MR.) at the end. I got a letter from DG solicitors with MS andn Dear Madam on it. Barstewards. In my reply I told them I was offended and in their reply they didn't even mention it. Once the cheque is cleared I will complain to them about it. I also want my daily interest!

Anyway.....here's the letter I'm replying with. let me know what you think:

REF: SETTLEMENT OF CREDIT CARD CHARGES

CREDIT CARD NUMBER: xxxxx

Thank you for your letter dated 17th August 2006 regarding the refund of my credit card charges.

I would like to thank you for the time and effort you have spent dealing with my claim. I was fully aware of the circumstances in which HSBC levies unlawful ‘fees’ on credit cards however thank you for confirming this.

I would like to confirm that I have received the cheque for £45.00, however I disagree with the contention of it being as a “gesture of goodwill” as I am quite confident that I can prove my case in court and prove that these are in fact penalties that you are trying to cloak as a service charge. I am also very confident that a judge will also see it this way. Whilst I have to mitigate my loss I am prepared to accept the figure of £45.00 you have sent me. I will accept this as full and final settlement of the cash element of this particular claim. I reject all other conditions you have attached: Unless you would like to negotiate a payment for this extra service you are asking from me, as a separate agreement?

In response to you’re request that I “agree to not make any further claims or take legal action on the matter.” I would like to point out that applying restrictions to a person’s ability to take legal action against another person is a violation of their Human Rights. If I receive any other communication from HSBC or their third parties at any time in the future stating a clause like this, I will have no option but to report HSBC to the relevant authorities to investigate possible breaches of the Human Right’s Act, taking action where necessary.

I appreciate you arranging information about manual interaction regarding my credit card account to be sent to me. My rights under the Data Protection Act (Data Protection Act) compel you to provide a copy of every piece of information HSBC holds on me. I would therefore like this to include all notes that are held about me within your department along with any notes that were made by your colleagues in relation to phone calls, email messages and the like. I do not require any more copies of my statements at this present time.

Well he's received it and I got a copy of all notes from my credit card account.

The cheque's cleared and I've got my money - donation to follow asap!

Just a note to say to everyone do not give up, use this site and go for every penny of YOUR money (even if it is a penny - or £45, like I've just received!!).
