Default Travel Policy & Timing of Pregnancy!

Is it really that clear cut that pregnancy (all things being well) is categorically, absolutely, non-disputedly excluded from travel insurance policies -- because it is not an illness??

Here is my problem:
-- wife and I booked our trip-of-the-life-time to Tanzania - literally, just 5 weeks ago.

-- Unknown to ourselves, at the time of paying down those thousands and thousands of pounds of non-refunable, non-exchangeable tickets and fees, she was 1 week pregnant....!

-- Having just found out from a trip to the doctors that she is literally 6 wks into the pregnancy (wife and baby doing great by the way - not likely to have miscarraige) -- then the doctor said no sensible GP will now give yellow fever vaccination to a pregnant woman!

-- Tanzania requires Yellow Fever vaccination as an absolute must for any travellers setting foot into the country. It is a very high risk area.

-- So I called up my travel insurer today, explained the situation.

They said we're not covered, because pregnancy is not an illness.

Anyone come across this before, and have any idea whether there is anything I can do about this unfortunate state of affairs?

The parties are free to choose the law applicable to the Insurance. Unless specifically
agreed to the contrary, the Insurance shall be subject to English Law.
COMPLAINTS PROCEDURE
We are dedicated to providing YOU with a high quality service and we want to ensure
that we maintain this at all times. In the event that YOU wish to make an enquiry or
complaint regarding the handling of YOUR Insurance, please contact Complaints
Department, Crispin Speers & Partners Ltd. St Clare House, 30-33 Minories, London
EC3N 1PE. Telephone 020 7977 5700 who will investigate the matter on YOUR
behalf. In the event that YOU are not satisfied with the outcome and wish to make a
complaint YOU can do so at anytime by referring the matter to Complaints
Department, Lloyds, One Lime Street, London EC3N 7HA. Telephone 020 7327

A complaint that cannot be resolved may be referred to the Financial Ombudsman
Service, details of which will be provided at the appropriate time.
Crispin Speers & Partners Ltd. are covered by the Financial Services Compensation
Scheme (FSCS). You may be entitled to compensation from the scheme if we cannot
meet our obligations. This depends on the type of business and the circumstances of
the claim.

ELIGIBILITY
YOU must ensure that YOU meet the eligibility criteria specified below where YOU
have paid the couple, family or single parent family premium.
Couple –YOU and YOUR spouse or permanent companion living at the same
address.
Family –YOU and YOUR spouse or permanent companion residing at the same
address and up to 6 of YOUR named children under 18 years of age or under 23 years
of age if in full time education at the commencement date of the PERIOD OF
INSURANCE.
Single Parent Family –YOU and up to 6 of YOUR named children under 18 years of
age or under 23 years of age if in full time education at the commencement date of the
PERIOD OF INSURANCE.
No mid term adjustment to the level of cover during the period of insurance is
permitted unless as a direct result of an approved lifestyle.
All INSURED PERSONS including CHILD or CHILDREN may travel
independently and unaccompanied.

PRE TRAVEL ADVICE
We strongly recommend that you contact the Foreign & Commonwealth Office
(FCO) Travel advice website for up to the minute travel information on all areas and
countries at British Foreign & Commonwealth Office (FCO) Home. Alternatively telephone 0870 606 0290
The FCO are running a campaign for UK citizens travelling overseas called ‘Know
Before You Go’ which we fully endorse and support.
In particular we would draw your attention to Exclusion 15 (War and Terrorism) of
the exclusions that apply to all sections as this specifically refers to the advice given
by the FCO.
24 HOUR MEDICAL EMERGENCY SERVICE
In the event of a medical emergency covered by this Insurance YOU must call the 24
hour telephone service operated for YOUR benefit by the Medical Emergency
Service. It is important to note that this Insurance only covers IN-PATIENT hospital,
clinic or nursing home expenses, repatriation to YOUR HOME, or CURTAILMENT
of YOUR TRIP authorised by the Medical Emergency Service. They must be notified
within 48 hours of admission for IN-PATIENT treatment and before departure to the
United Kingdom for CURTAILMENT.

HOW TO MAKE A CLAIM

In no event should a claim be notified later than 31 days after completion of the
relevant TRIP.
When completed the claim form should be submitted together with a copy of YOUR
confirmation of cover and relevant documentation. Failure to complete and sign the
claim form properly or to omit to include the required documentation may prejudice YOUR right to indemnity or benefit under the Insurance. YOUR attention is also drawn to the EXCESS applicable to certain benefit Sections of the Insurance.
If medical attention is received for injury or sickness, a medical certificate showing the nature of the injury or illness must be obtained, together with accounts which should, if possible be settled.
Any loss, damage or delay to PERSONAL BAGGAGE whilst in the custody of a carrier (for example an airline or transport company) must be notified in writing to such carrier within 3 days and a Property Irregularity Report (PIR) obtained.
Any loss of MONEY or PERSONAL BAGGAGE must be reported to the Police (and hotel management if applicable) within 24 hours of discovery and a written report obtained.

MEANING OF WORDS
CLOSE BUSINESS COLLEAGUE - Means an associate of YOURS in the same
employ resident in the United Kingdom, whose absence from work necessitates the cancellation or CURTAILMENT of the TRIP as certified by a senior director of the Company for whom YOU work.
CLOSE RELATIVE - Means YOUR spouse, child, infant, parent, grandparent,
brother, sister, parent-in-law, son/daughter-in-law, grandchild or fiance(e) who is resident in the United Kingdom.
CURTAILMENT - Means the necessary and unavoidable abandonment of the TRIP following written medical advice by a registered medical practitioner to either return to the United Kingdom or to attend a hospital overseas as an IN-PATIENT as authorised by the Medical Emergency Service or as a result of circumstances stated in Sections 8.2, 8.3, 8.5, and 8.6.
EXCESS - Means the amount of any claim that YOU have to pay before WE will make a payment to YOU. In the event that YOU make a claim under more than one section of the insurance the EXCESS will apply to each person, each claim.
HOME - Means YOUR usual place of domicile in the United Kingdom.
HIJACK –Means unlawful seizure or wrongful exercise of control of an aircraft or conveyance, or the crew thereof, in which YOU are travelling as a passenger.
IN-PATIENT - Means person(s) who are admitted to a licensed hospital or clinic and stay for one or more nights, for the sole purpose of receiving medical treatment.
INSURED PERSON, YOU OR YOUR(S) –Means Person(s) who are named in the Schedule as person(s) to be insured. (Each person is considered to be separately insured).
INTRINSIC VALUE - Means the actual cash value of the item at the time of loss or damage including appropriate deductions for wear and tear.
LOSS OF EYE(S) - Means total and irrecoverable loss of sight from the eye(s).
LOSS OF LIMB(S) - Means loss of a hand or foot by permanent physical severance at or above the wrist or ankle including total and permanent loss of use of a hand or foot.
MONEY - Means bank notes and coins of any country, travellers cheques, postal and money orders, passport, driving licence, travel tickets, petrol coupons and credit vouchers, being carried by YOU or whilst in a locked safe or safety deposit box.
PERIOD OF INSURANCE - Means the period stated in the Schedule. However, the PERIOD OF INSURANCE in respect of Cancellation commences on the date of booking YOUR TRIP and ends immediately YOUR TRIP begins, provided YOUR TRIP is not booked more than 12 months in advance of its commencement date and Cancellation takes place during the PERIOD OF INSURANCE stated in the Schedule.
PERMANENT TOTAL DISABLEMENT - Means disablement which entirely
prevents YOU from engaging in or attending to any business or occupation
whatsoever for at least 12 consecutive months after the date of the accident causing the disablement and at the expiry of that period being beyond hope of improvement.
PERSONAL BAGGAGE - Means YOUR suitcases and similar containers, their
contents and articles carried or worn by YOU including YOUR VALUABLES but excluding MONEY, stamps, documents, contact or corneal lenses, dentures, hearingaids, fragile articles, ski equipment or business goods and samples.
TRIP - Means a holiday/journey to countries within the Geographical Area stated in the Schedule and not exceeding the maximum duration of 45 days, which must begin and end during the PERIOD OF INSURANCE. The trip is deemed to commence from the time YOU leave YOUR HOME or YOUR PLACE OF BUSINESS whichever is the later and the end of YOUR trip is deemed at the time YOU return to YOUR HOME or YOUR PLACE OF BUSINESS whichever is the earlier. A trip within the United Kingdom when YOU spend one or more nights away from YOUR HOME in pre-booked accommodation is also covered.
VALUABLES - Means photographic, audio, video, computer, telecommunications and electrical equipment of any kind (including CD’s, computer games, video and audio tapes), telescopes and binoculars, spectacles and sunglasses, antiques, jewellery, watches, furs, perfumes, leather goods, animal skins, silks, precious stones and articles made of or containing gold, silver or precious metals.
WE, OUR OR US - Means Certain Underwriters at Lloyd’s.
GEOGRAPHICAL AREAS
Area 1: The continent of Europe west of the Ural mountains, including its
neighbouring islands and non-European countries bordering the
Mediterranean (excluding Lebanon, Libya, Syria and Jordan).
Area 2: Worldwide

CONDITIONS OF THIS INSURANCE
The granting of cover and payment of claims under this Insurance is dependent on the following:
1. That YOU observe and fulfil all the terms and conditions of this Insurance by completing anything to be done or complied with by YOU or anyone acting on YOUR behalf.
2. That YOU provide at YOUR own expense, all certificates, information and
evidence required by US or OUR appointed representatives.
3. That no person will admit liability or make any offer or promise of payment without OUR prior written consent.
4. That YOU acknowledge that WE may at our own expense take proceedings in YOUR name to recover compensation from a third party in respect of any cover provided by this Insurance, and that any amount recovered shall belong to US.
5. That in the event of YOUR death, WE shall have the right to have a post mortem carried out at OUR expense.
6. That YOU will take all reasonable and proper care to safeguard against accident or illness or loss of or damage to YOUR property, as if this Insurance was not in force. Failure to do so will prejudice YOUR position under this Insurance.
7. That YOU may not transfer YOUR interest in this Insurance.
8. That in the event of a fraudulent claim being made by YOU or anyone acting on YOUR behalf all cover under this Insurance shall be forfeited.
9. That YOU immediately notify US in the event of any occurrence likely to give rise to a claim under this Insurance in accordance with the instructions contained in this Certificate but in any event within 31 days of YOUR return from the TRIP.

EXCLUSIONS APPLICABLE TO ALL SECTIONS
WE will not pay for any claim arising directly or indirectly from:
1. A heart, breathing or malignant condition for which YOU have received INPATIENT treatment during the 6 months prior to booking YOUR TRIP,
or YOUR failure to seek YOUR doctors agreement that YOU are fit to travel
in respect of any other condition for which YOU have received IN-PATIENT
treatment during the 6 months prior to booking YOUR TRIP,
or where at the time of booking YOUR trip YOU or any person whose
condition gives rise to a claim:
i) is expected to give birth within two months of the return date of YOUR TRIP;
ii) is receiving or on a waiting list for any hospital or clinic treatment;
iii) is travelling against the advice of a medical practitioner or for the purpose of obtaining medical treatment abroad;
iv) has received a terminal diagnosis.
2 alcoholism, anxiety, depression, use of drugs (other than drugs taken in
accordance with the treatment prescribed and directed by a registered medical practitioner but not for the treatment of drug addiction), drunkenness, mental disorder, suicide, stress, venereal disease or wilfully self inflicted injury or illness;
3 any injury, illness, death, loss, expense, or other liability attributable to HIV (Human Immunodeficiency Virus) and/or any related illness including AIDS (Acquired Immune Deficiency Syndrome) and/or any mutant derivative or variation thereof however caused;
4 aviation and aerial activities (other than solely as a fare paying passenger in a licensed aircraft flown by a pilot holding a valid pilot’s licence);
5. claims brought about or increased by YOUR own act or omission;
6. computer failure or fear of computer failure or the inability of any equipment or any computer program to recognise, interpret correctly or process any date as its true calendar date or to continue to function correctly beyond that date. This exclusion only applies to Section 4, Section 6 and Section 9;
7. consequential loss of any nature;
8. loss or damage in respect of any property more specifically insured elsewhere or any claim recoverable under another insurance;
9. manual work (not including bar work, waitressing, fruit picking and other
similar light casual work not requiring the use of machinery or power tools) or hazardous occupation;
10. motor cycling other than under 125 c.c. and when the driver is duly qualified and is in possession of a current full United Kingdom driving licence and the rider and passenger are wearing a safety crash helmet;
11. one-way trips;
12. self exposure to needless peril except in an attempt to save human life, or YOU engaging in any criminal or illegal act;
13. any loss where the INSURED PERSON was aged 71 years or over at the
commencement date of the PERIOD OF INSURANCE;
14. any sport or leisure activity which is the main purpose of YOUR TRIP (other than winter sports or scuba diving TRIPS up to a maximum of 24 days in all during the Period of Insurance and provided YOU have paid the appropriate premium), sailing / yachting outside coastal waters, scuba diving at a depth of more than 30 metres or solo diving, watersports involving white water rapids in excess of Grade 3, trekking at altitudes above 3,000 metres, professional sports and activities or any sports or activities which require a licence, or a certificate of proficiency, or such other document as appropriate to participate;
15. War (whether declared or not), invasion, civil war, armed hostilities, any act of terrorism, rebellion, revolution, insurrection, military or usurped power or confiscation or nationalisation or destruction of or damage to property by or under the order of any government or local authority, EXCEPT claims arising under sections 1 and 2 where YOU are not actively engaged in any of the stated events and/or where YOU have not travelled or YOU do not remain contrary to Foreign & Commonwealth Office travel advice.
It is further noted and agreed that notwithstanding the foregoing WE will not pay for any claim arising directly or indirectly from the utilisation of Nuclear, Biological or Chemical weapons of mass destruction howsoever these may be distributed or combined.
For the purpose of this exclusion:
i) Utilisation of Nuclear weapons of mass destruction means the use of any explosive nuclear weapon or device or the emission, discharge, dispersal, release or escape of fissile material emitting a level of radioactivity capable
of causing incapacitating disablement or death amongst people or animals.
ii) Utilisation of Chemical weapons of mass destruction means the emission, discharge, dispersal, release or escape of any solid, liquid or gaseous chemical compound which, when suitably distributed, is capable of causing
incapacitating disablement or death amongst people or animals.
iii) Utilisation of Biological weapons of mass destruction means the emission, discharge, dispersal, release or escape of any pathogenic (disease producing) micro-organism(s) and/or biologically produced toxin(s)
(including genetically modified organisms and chemically synthesised toxins) which are capable of causing incapacitating disablement or death amongst people or animals.
16. Radioactive contamination of any description however caused;
17. Winter Sports (other than as covered in Section 12 and provided YOU have paid the appropriate premium). In any event there shall be no cover under this Insurance for cresta run, heliboarding, heliskiing, ski acrobatics, ski flying, ski jumping, ski mountaineering, ski randonee, speed skiing or ski stunting.

SECTION 1 PERSONAL ACCIDENT
YOU are covered for
WE will pay the following benefits if YOU sustain bodily injury during the TRIP caused solely and directly by accidental external violent and visible means and such bodily injury within 12 months of the date of the accident is the sole and direct cause of death or LOSS OF EYE(S) or LOSS OF LIMB(S) or PERMANENT TOTAL DISABLEMENT
(A) Death ) Up to the amount stated
(B) LOSS OF LIMB(S) or LOSS OF EYE(S) ) in the Schedule.
(C) PERMANENT TOTAL DISABLEMENT )
YOU are not covered for
1. More than £5,000 in respect of all Insured children
2. Any claim for more than the amount stated in the Schedule in respect of any one INSURED PERSON.

SECTION 2 MEDICAL AND OTHER EXPENSES AND SECTION 3 HOSPITAL BENEFIT
YOU are covered under Section 2 for
WE will pay up to the amounts stated in the Schedule if YOU sustain bodily injury or suffer illness during the TRIP, which results in:
1. reasonable and necessary medical, hospital and treatment expenses, the costs of emergency dental treatment caused solely and directly by accident, doctors fees and transportation charges for sending YOU to hospital;
2. reasonable additional accommodation and travelling costs for one person
required upon medical advice to stay with, travel to or escort YOU HOME;
3. reasonable transportation costs for repatriation to the United Kingdom which is deemed necessary by the Medical Emergency Service;
4. the reasonable cost of conveying YOUR body or ashes to the United Kingdom, or alternatively to pay up to £1,000 towards the cost of burial or cremation outside of the United Kingdom in the event of YOUR death;
5. reasonable additional accommodation and transportation costs for YOUR
necessary return HOME as a result of the death or serious injury or illness of a CLOSE RELATIVE or CLOSE BUSINESS COLLEAGUE or due to events
stated under Sections 8.2, 8.3, 8.5 and 8.6;
6. the necessary and reasonable additional transport and accommodation expenses of a person to replace YOU in the event that YOU are unable to continue YOUR business TRIP following repatriation to the United Kingdom or CURTAILMENT as may be covered by this Insurance, and provided that all such expenses are authorised by the Medical Emergency Service.

SPECIAL CONDITIONS
WE reserve the right to:
(i) repatriate YOU when, in the opinion of the treating doctor and the Medical Emergency Service, YOU are fit to travel;
(ii) avoid further liability in the event that YOU refuse repatriation when, in the opinion of the treating doctor or the Medical Emergency Service, YOU are fit to travel;
(iii) transfer YOU to the hospital, clinic or location of OUR choice when, in the opinion of the treating doctor and the Medical Emergency Service, YOU are fit to be transferred.
YOU are covered under Section 3 for
WE will also pay the amount stated in Section 3 Hospital Benefit for each complete 24 hours YOU are confined as an IN-PATIENT outside of the United Kingdom up to the amount stated in the Schedule in all.
YOU are not covered for
The following exclusions apply to Section 2 and 3
1. the first £40 of each and every claim (the EXCESS) in respect of Section 2;
2. any treatment or aid obtained in the United Kingdom;
3. any surgical or medical treatment which can reasonably be delayed until YOUR return to the United Kingdom;
4. any treatment or medication which at the time of departure is known to be required or continued during the TRIP;
5. any medical or other expenses incurred more than 12 months after the date of the injury or illness to which the claim refers;
6. the cost of dentures, dental appliances, false limbs, hearing aids, contact or corneal lenses or spectacles (prescription or otherwise);
7. any IN-PATIENT hospital, clinic or repatriation costs not authorised by the Medical Emergency Service;
8. the additional cost of a single or private room at a hospital, clinic or nursing home except when the registered medical practitioner treating YOU considers it necessary.

SECTION 4 BAGGAGE, PERSONAL EFFECTS AND EQUIPMENT
YOU are covered for
WE will pay up to the amount stated in the Schedule, for loss of or damage to PERSONAL BAGGAGE during the TRIP which is YOUR property subject to proof of ownership for VALUABLES.
WE reserve the right to repair, replace or pay the INTRINSIC VALUE of any lost or damaged article. The amount WE will pay in respect of any article, pair or set is limited to the amount stated in the Schedule except in respect of VALUABLES where OUR overall payment limit is the amount stated in the Schedule.
Children under the age of 16 years at the date of validation of the Schedule are restricted to 50% of the amounts stated in the Schedule.

SECTION 5 DELAYED BAGGAGE
YOU are covered for
WE will pay up to the amount stated in the Schedule for the necessary emergency purchase of replacement items provided WE receive proof of expenditure if YOUR PERSONAL BAGGAGE is misplaced on the outward journey for at least 10 hours from the time of YOUR arrival at the TRIP destination.

SECTION 6 MONEY AND DOCUMENTS
YOU are covered for
WE will pay up to the amount stated in the Schedule for loss of MONEY during the TRIP whilst carried by YOU or whilst in a locked safe or safety deposit box.
Children under the age of 16 years at the date of validation of the Schedule are restricted to 50% of the amounts stated in the Schedule.
YOU are not covered for
The following exclusions apply to Sections 4, 5, 6, 13.1, 13.2 & 13.3
1. the first £40 of each and every claim (the EXCESS) in respect of Sections 4, 5, 6, 13.1, 13.2 and 13.3;
2. any loss not reported to the Police within 24 hours of discovery and a written Police Report obtained and sent to US;
3. any loss of or delay or damage to YOUR property whilst in the custody of an airline or other carrier unless immediately upon discovery of the loss, delay or damage YOU notify the carrier and obtain and send their Property Irregularity Report (PIR) to US;
4. any loss of PERSONAL BAGGAGE or VALUABLES or YOUR own or hired
Winter Sports equipment whilst left unattended at any time unless YOU have left them secure in a locked hotel room, locked apartment, locked holiday residence or other locked and secure self contained accommodation;
5. loss of PERSONAL BAGGAGE or VALUABLES or YOUR own or hired
Winter Sports equipment from an unattended vehicle other than PERSONAL
BAGGAGE (but not VALUABLES) from a locked enclosed boot or concealed
by the parcel shelf in the fixed position in a hatchback or estate vehicle and there is evidence that entry was effected by violent and forcible means;
6. any loss of MONEY or documents whilst left unattended at any time or whilst in a suitcase or in the custody of another person;
7. any loss or damage due to delay or confiscation by Customs or other officials;
8. any loss or damage to stamps, documents (other than as covered under Section
6), contact or corneal lenses, dentures, hearing aids, fragile articles or business goods and samples;
9. any loss or damage to sporting equipment whilst in use other than YOUR own or hired Winter Sports equipment;
10. any loss or damage due to wear and tear, deterioration, moth or vermin, climatic or atmospheric conditions or mechanical or electrical breakdown;
11. any loss or damage due to staining or any process of dyeing or cleaning or water damage however caused;
12. any loss or damage to pedal or motor cycles, watercraft, prams, buggies, pushchairs or wheelchairs;
13. any loss of travellers cheques or cheques not immediately reported to the local bank or agent of the supplier in accordance with their instructions;
14. any shortages due to error, omission, exchange or depreciation in value;
15. any loss resulting from loss or theft of credit cards.

SECTION 7 PERSONAL LIABILITY
YOU are covered for
WE will pay up to the amount stated in the Schedule (inclusive of costs) if YOU in YOUR private capacity become legally liable to pay for accidental bodily injury to third parties or accidental damage to third party property, arising from an incident occurring during the TRIP.
YOU are not covered for
1. the first £40 of each and every claim (the EXCESS) other than claims for
damage to furniture, fixtures or fittings for which YOU are not covered for the first £250;
2. Employers or Contractual Liability;
3. liability to any members of YOUR family or to a travelling companion or friend or colleague; any liability arising directly or indirectly from or due to:
4. animals belonging to YOU or in YOUR care, custody or control;
5. any wilful, malicious or unlawful act;
6. pursuit of a trade, business or profession, employment or occupation;
7. ownership, possession or use of aircraft, hangliding, hot air ballooning, parachuting, use of firearms, vehicles or watercraft;
8. legal cost of any proceedings that result from any criminal or illegal act;
9. insanity, the use of alcohol, drugs (except as medically prescribed) or drug addiction;
10. the supply of goods or services;
11. any form of ownership or occupation of land or buildings (other than occupation only of any temporary residence).

SECTION 8 CANCELLATION AND CURTAILMENT
YOU are covered for
WE will pay up to the amount stated in the Schedule for loss of irrecoverable deposits or payments for unused travel and accommodation paid in advance or contracted to be paid as a result of the necessary and unavoidable cancellation of YOUR TRIP due to:
1. the death, injury or illness of YOU, a CLOSE RELATIVE, CLOSE BUSINESS
COLLEAGUE, travelling companion or person with whom YOU intend to stay;
2. YOUR presence being requested by the Police following YOUR HOME or
business premises being rendered uninhabitable during the TRIP or in the 7
days prior to departure;
3. YOUR presence being requested by the Police following burglary or attempted burglary at YOUR HOME or business premises;
4. redundancy from a permanent position for which a proper redundancy notice has been supplied by YOUR employer in accordance with current United Kingdom employment legislation;
5. YOU being called to be a witness or for jury service where postponement has been denied by the Court;
6. official requirements for YOU to attend emergency duty in British Military, Medical or Public Service;
7. a Government regulation following an epidemic or natural disaster that stops YOU from travelling.
In respect of CURTAILMENT, WE will pay up to the amount stated in the Schedule for the proportionate amount of YOUR irrecoverable pre-paid costs of the TRIP, which will be based on the complete number of days YOU are at HOME or hospitalised as an IN-PATIENT.
YOU are not covered for
1. the first £40 of each and every claim (the EXCESS) other than loss of deposit claims, for which YOU are not covered for the first £10;
2. any loss arising from a CLOSE RELATIVE, CLOSE BUSINESS
COLLEAGUE, travelling companion or person with whom YOU intend to stay
who, at the time of YOUR taking out the Insurance or booking the TRIP,
whichever is the later:
i) has received IN-PATIENT hospital treatment in the 6 months prior;
ii) has received a terminal prognosis;
iii) is receiving or on a waiting list for any hospital or clinic treatment.
3. any expenses payable by the tour operator, hotel or airline;
4. any delay in commencement of the TRIP;
5. any surcharges levied by the tour operator, which increase the brochure prices;
6. any losses arising from YOUR failure or delay in notifying the travel agent, tour operator or provider of service immediately it may be necessary to cancel or curtail YOUR travel arrangements;
7. the costs of CURTAILMENT not approved by the Medical Emergency Service;
8. any loss arising from the financial failure, insolvency, bankruptcy or default of the tour operator.

SECTION 9 TRAVEL DELAY, ABANDONMENT AND MISSED DEPARTURE
YOU are covered for
1. WE will pay up to the amount stated in the Schedule in the event that the departure of the aircraft, coach, sea vessel or train in which YOU have arranged to travel is delayed on the outward or homeward journey by at least 10 hours from the time shown in the official travel itinerary as supplied to YOU due to strike, industrial action, adverse weather conditions, traffic flow congestion or mechanical breakdown, either:
(a) £20 for the first full 10 hours delay and £5 for each full following 5 hours up to the maximum amount per INSURED PERSON or
(b) up to the final invoiced paid costs of the TRIP not exceeding the amount stated in the Schedule that YOU cannot recover from any other source if YOU decide to abandon YOUR outward TRIP after at least 10 hours delay from the time of departure stated in the official travel itinerary.
2. WE will pay up to the amount stated in the Schedule for additional travel and accommodation expenses necessary to reach YOUR booked holiday destination should YOU arrive at YOUR international departure point too late to commence YOUR TRIP as a result of the failure of public transport services due to the perils stated above and/or the mechanical breakdown of the vehicle in which YOU are travelling to reach YOUR international departure point.
WE will only pay compensation under 9.1(a) or 9.1(b) or 9.2.
YOU are not covered for
1. the first £40 of each and every claim (the EXCESS) made by YOU under
Sections 9.1(b) or 9.2;
2. any losses which are the result of YOUR failure to check in at the airport, port or railway station in accordance with the travel itinerary supplied to YOU;
3. any losses if YOU fail to obtain written confirmation from the airline, coach or railway operator or shipping company or their agents showing the period of and reasons for the delay;
4. any losses arising from strike or industrial action which commenced or was announced before the date of booking YOUR TRIP or purchasing insurance whichever is the later.

SECTION 10 HIJACK
YOU are covered for
WE will pay up to the amount stated in the Schedule for each complete 24 hours YOU are detained in excess of 24 hours up to the amount stated in the Schedule should YOUR means of transport be subject to a HIJACK during a TRIP.
The PERIOD OF INSURANCE is automatically extended in the event of HIJACK.

SECTION 11 LEGAL EXPENSES
YOU are covered for
WE will pay up to the amount stated in the Schedule for costs and expenses incurred by YOU or YOUR legal representatives for legal proceedings against a third party for compensation and/or damages arising directly from or out of an incident causing YOUR injury or YOUR death during the TRIP, provided that WE have complete control of the proceedings and of the selection, appointment and control of all legal
advisers.
YOU are not covered for
1. any costs or expenses incurred by YOU for any claim brought against a carrier, tour operator, travel agent or US;
2. any costs or expenses incurred before the granting of OUR support, which WE will not unreasonably withhold. WE reserve the right to withdraw at any stage and shall not then be liable for any further costs or expenses;
3. any claim reported more than 180 days after the incident occurs which gives rise to such claim;
4. any claim where WE consider the prospects of success in achieving a
reasonable settlement are insufficient and/or where WE consider the laws,
practices and/or financial regulations of the country where the incident occurred will preclude US from obtaining a satisfactory settlement.

SECTION 12 CATASTROPHE
YOU are covered for
WE will pay up to the amount stated in the Schedule should YOU be forced to move from YOUR pre-booked accommodation as the result of fire, lightning, explosion, earthquake, avalanche, storm, tempest, hurricane, flood, medical epidemic or local Government directive which is confirmed in writing by local or national authority for irrecoverable travel or accommodation costs necessarily incurred to continue with the
TRIP or, if the TRIP cannot be continued, for YOUR return HOME.
YOU are not covered for
1. YOUR decision not to remain in YOUR booked accommodation when official directives from local authorities state that it is acceptable to do so;
2. any costs or expenses payable by or recoverable from the tour operator, airline, hotel or other provider of services.

It isnt an illness, so you are not covered. Simple as that really - the insurance is only as good as its Terms and Conditions. I think it is somewhat harsh in many ways, but the insurers are well within their rights IMO to not compensate. Mossycat may be able to advise better...

I think your best bet would be to see if the travel company will transfer you to another holiday, that is suitable for you.

you could send a PM to Mosseycat with a link to your thread, have you considered writing, to ask your insurance company to look again at your claim.
The reason I suggest this action is with their final responce, you can escalate your complaint to the FOS Financial Ombudsman Service

I have already asked MC about this in private and he had nothing to add, hence the lack of reply.

I would suspect that a FOS complaint is a waste of time, as the insurer has technically as per their T&Cs done nothing wrong. This was an uninsured risk.

Couldn't disagree more.

The clause being invoked isn't under the heading of illness, but cancellation, and it may not be qualified as an insured risk, but it isn't qualified under exclusion either. Since no insurance could possibly quantify every single clause under which they will pay out, if it isn't specified under exclusions then the insurance is supposed to pay up.

As long as OP obtains confirmation from their GP that his wife can not get the injection now which means that she can not travel without putting herself at risk, the insco would be treading on very thin grounds to refuse to pay up.

Mr Shed, travel insurance covers quite a few aspects of pregnancy even though it isn't an illness, it is however a medical condition and is therefore very much covered by travel insurance.

Insurance is literally only as good as its terms, and its explicitly stated insured risk.

The insurance, as per its terms, DOES NOT COVER THIS EVENTUALITY.

Incorrect. The exclusions are what, well, exclude what will not be covered. That's why they're called exclusions.

Ok (apologies to OP for hijack), let's take another example: Putting aside the vaccination for one momeny, let's say that Mrs OP develops a problem with pregnancy. Her GP isn't happy for her to travel. The insurance doesn't say anything about that, yet I can assure you that they'd be covered. No ifs, no buts.

Yes, travel insurance is a catchall for "medical conditions" unless specifically excluded. Not illnesses, medical conditions. I can also tell you from considerable personal knowledge and experience that even when the condition is borderline on exclusion zone, travel insurance will stretch where car or household insurance won't, because it is human beings and it is difficult to draw a line in the sand when it comes to the vast array of medical conditions.

If you want specifics in this instance, the cover is to be found in:

EXCLUSIONS APPLICABLE TO ALL SECTIONS
WE will not pay for any claim arising directly or indirectly from:
1. A heart, breathing or malignant condition for which YOU have received INPATIENT treatment during the 6 months prior to booking YOUR TRIP,
or YOUR failure to seek YOUR doctors agreement that YOU are fit to travel
in respect of any other condition for which YOU have received IN-PATIENT
treatment during the 6 months prior to booking YOUR TRIP,
or where at the time of booking YOUR trip YOU or any person whose
condition gives rise to a claim:
i) is expected to give birth within two months of the return date of YOUR TRIP;
ii) is receiving or on a waiting list for any hospital or clinic treatment;
iii) is travelling against the advice of a medical practitioner or for the purpose of obtaining medical treatment abroad;
The corollary of this is that if OP has sought their GP's advice and he has advised against travelling (because can't give injection therefore it would be unsafe for Mrs OP to travel) they must be covered since they wouldn't be covered if they were to go ahead even though the GP has advised against it.
