Default Cancellation Charges - Operator Hassling Me

Hi, I cancelled my holiday about 4 weeks ago and we were suppose to go on hols in June 13th.

Tour operator is now saying I owe them £350 for cancellation charges under their Terms and Conditions. Thing is I never signed and hols was booked over telephone. They never made me aware of their cancellation charges either when I booked.

Thang is they phone me on average 5 times a day and write all over the envelopes they send me 'BAD DEBTOR' and 'PLEASE DO NOT IGNORE - VERY URGENT' in big bold letters. Postman must think im nuts! Ive repeatedly told them to contact me by letter and I have never ignored 1 letter they have sent me but they are the ones ignoring my requests. Im at a loss, what can I do?

Even if you book over the phone its an agreememnt because they tell you that this booking is legally binding and that you are to agree to terms and conditions at the time of booking,even if you never signed anything and unfortuately the lead name has taken on the responsibility of the whole booking...

I booked a holiday with travelcity direct and paid a low deposit,but when i got the invoice it said pool heat was not included i tried to get them to add it at no extra cost and said i had def booked it,but they said i did not when i booked in on the phone,i canelled the holiday and then i got a bill for £650 for the rest of the deposit,i let them take it court ,but at the last minute i phoned them and offered them £5 per month because it was making me very ill sleepless nights at the thought of going to court,they won because of their scare tactics.

You have a couple of letters to write young lady.

What they are doing is not on and is classed by the Office of Fair Trading as:

Physical/psychological harassment

j. acting in a way likely to be publicly embarrassing to the debtor either
deliberately or through lack of care, for example, by not putting
correspondence in a sealed envelope and putting it through a letterbox, thereby running the risk that it could be read by third parties.


What you are receiving is likely to be publicly embarrassing to the debtor deliberately

Your must write in the first instance to the OFT and include copies of those envelopes, they will then direct you on what to do next.
Don't delay on this, have it ready for posting first thing Tuesday morning.

Send copies and not the actual envies, they might get lost. They will ask you if they need the originals.

Hi, I sent a letter to the company detailing that what they were doing was abuse and causing embarassment to me and voila..........not a peep for 2-3 weeks now, no letters or phone calls! Dont know if it that is a bad or good thing!
