Default Hennie V Marbles

Hi everyone

I calculated that marbles have charged me £150 in late fees / overlimit fees over the last 4 years since I opened by account. I sent them the letter in the library requesting the money back and received a letter in reply today saying that they think the charges are fair and reasonable and that they're not prepared to refund. Pretty standard I presume.

So now I need to move to the next stage. Is this the point where I have to fill in the small claims form on the moneygov site? And also at this points can I claim the 8% interest charges on top?

Thanks

Before continuing I would suggest a good read of the FAQ's, and the step-by-step guide.

Hi Alan

I've just been reading through them, from what I can gather from the step-by step, I think I'm at the filling a claim stage, but looking through the other cases in this section, others seem to have received the same reply as I did and then sent another letter - so I'm a little confused.

If you have sent the preliminary request for refund, then you need to send a Letter Before Action.

Sent my LBA on the 2nd June and Marbles have not responded. Have phoned them and they are claiming that they have not received it - hmm. It was posted by recorded delivery addressed to the same person who responded to my initial request for repayment. The letter has not come back to me, so they must have recieved it.

Marbles have finally responded to my LBA after I had to re-send it. They have offered me half of what I was claiming. Sounds the norm from them having just read through a few of the other threads.

I'm going to send them another letter rejecting the offer, giving them another chance to reconsider & then file the claim.

marbles didnt charge me, but remind them you are asking for your statements subject to the data prot act and that is £10.00, not just ordering statements to paper your walls.

Sorry for the late reply. I sent off a £10 with the standard letter in the library requesting my statements. They then sent my statements and sent me my cheque back.
