Just two years and a few days after I started my claim against the Abbey, it's time to start a claim against what was my parachute account with the A&L. All statements are in place, it's time to get the spreadsheets and template letters out again. Not as much this time, but £1200 over two years is still a lot of money to have had deducted from my account without so much as a by-your-leave

Best of luck to you. I'm doing exactly the same. A&L was my parachute account but i'm now owed £115. My prelim letter went in with charges yesterday.. i'll race you.lol.

I also need to get started with round 2 Barclays, Virgin Media, Barclaycard... i'd better get busy.

well, I've received a letter from a very nice man telling me he's going to look into the issue I've raised and give me his response and he's sent me a very useful leaflet telling me what to do if I have a concern over their services.

It took 3 days, but LBA sent off recorded delivery today........14 days and counting down, and because i'm a complete layabout scrounger, I won't have to pay the Court fees this time round

After two interim letters telling me they're really investigating my claim as thoroughly as possible, another letter from A&L today, enclosing an I & E form and giving me ten days to return it to them. Only trouble is the letter is dated 18th Feb!! Two weeks exactly to get it to me

I'll fill it in for them all nice and neatly, but I think I'll pop down to court as well and fill in an N1, as I don't have to pay at the moment

Well, as I've heard nothing from our friends at A&L for six weeks, I've been a patient man and sent them one more LBA, with a 14 day deadline before I dig out the N1 forms again.

In the meantime, I better do some brushing up on AQ's and POC's and UTTC's

Claim issue notice received, as well as an N24 to say the claim is stayed.

Time to write them a nice letter applying for the stay to be lifted in this particular case.

I think if I tell them " times is 'ard your worship! " it should be sufficient



Now where are those FSA guidelines when you need them?

yb, sorry to hijack a thread, but can you clarify your post for me a bit please. Are you saying that hardship doesn't count as grounds to lift a claim that's been stayed?

I'd always understood that hardship was one of the few grounds for the current blanket stay to be lifted in individual cases.

In county court claims the answer is NO.
If you go through the bank they can look at any claim even if it is stayed at court. The majority of cases being held up in the FOS logjam is due to the fact that insufficient information is given at the point it taken there and it therefore leads to long delays in the decision making process.

Stay lifts is a definite no goer(Tom Brennan has tried in court on one case and the answer was no).
BF hasn't really advocated anything to do with hardship on that thread, he has stated a view on Lloyds which I wouldn't disagree with because they notoriously difficult at times to crack.
I have a method of doing hardship claims and a good understanding of how they work so if it comes across differently to others then you have the choice to follow either approach and see how you get on. I'll stick to my approach though

Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
Are any of the arrears being paid off?
Did A&L respond to your financial hardship claim or I&E form?
Did they attempt to call you to discuss it?
