Default Settled at 2nd Offer **SETTLED**

Hi

Please can i get some help and Advise.

I sent off my first letter, requesting refund of charges, which total up to £772.80 .
I recieved a standard letter yesterday saying, that it is my responsibility to manage my account and as a gesture of goodwill they will only offer me £193.00 as a full and final settlement.

I dont want to accept this a full and final. Can i write to them saying i will accept this as a partial payment and im stll going to court for the rest unless, they give me a better offer.

I need some help writing letters as im so useless. please can someone send me a drafted letter they have sent or help me write one.

Please Please help, as im getting very worried now.

Many Thanks.

Hiya

I wrote something like this (copy & paste & fill in the your details)

Dear Sir/Madam,

ACCOUNT ROLL NUMBERS:

Your Reference:

In response to your letter offering £xxx as a goodwill gesture - your offer is accepted only as a partial repayment of the outstanding balance and I do not recognise it as a full and final settlement.

Although I appreciate your offer, I would like to notify you that my request was for £xxx, and should a positive response not be received by XX/XX/XXXX, then I shall have no option but to (**file a court action against you / submit a Letter Before Action).

I hope this matter can be resolved amicably and swiftly.
Yours sincerely,

(** delete according to where your claim is at)

Hope that helps

Good Luck with Your Claims

Hi Deepa,

There is a letter template in the Library for this:

http://www.consumeractiongroup.co.uk...ent-offer.html

Also don't forget to familiarise yourself with the FAQs as it will help you to understand the process better.

Hope this helps...

P.S. Stick to your own timetable in terms of the letters you need to send out - you don't need to wait for them to respond as each letter sets out the time they have been given by you in which to make contact. If the 14 days are up on the 5th, send the LBA then.

Hi there deepa1980,

I got my first offer yesterday of £168.....they owe me £2200!!! God knows how they are coming to these offers?? Mine isnt even 10%!!
Well Im due to send my LBA the same day as you, not gonna bother with the letter thanking them for the offer as I will just insert it in my LBA.

Ill keep watching your thread with interest seeing as though we're about the same stage! Good luck although I doubt you need it!

Good luck with your claim you will get your money back in the end it’s just a waiting game for the banks to see if you will back down. I never did went all the way to issue of court papers, 7 days after they acknowledged the claim they paid out. That was yesterday

They offered me a full refund after just 1 letter sent to them. They have said they can only put the ££ onto my credit card account & as there is no outstanding balance they can then transfer it to my bank account..long way round but we'll get there..

Hope you get well soon Depa
