Question Adams Vs Halifax ***WON***

Hi all,
This is my first post....
what a brilliant site this is,first of all i sent my data protection act letter to the halifax,i went into the branch with the £10 fee just so they couldnt say they hav'nt recieved it,this was in july got quite a swift response to be honest they sent the usaul letter a week later saying they will be with you in the next few days,which to my surprise i got all of my past 6 years statments trough the post days later.it took me a while but ive managed to calculate all the charges and comes to roughly £1,500,couldnt believe it! i have been quite stupid in the past few years mounting up some debts,struggling from month to month with bills etc. i have spent most of this month and last month reading through most of the posts and this site,its hopefully given me enough information and confidence to proceed with my claim,so im now going to send the first letter off this week,just a quick question do i put the intrest on top of the amount in this first letter or do i leave it untill the lba?

The only interest you can normally claim at this stage is the interest debited from your account that was caused by the charges. The complex version of the spreadsheet will work this part out for you.

There is an additional option, which is to claim interest on the amount of your losses at the contractual rate. This can be calculated by the 'Further Interest' sheet of the spreadsheet. If you do this you can't add the 8% s69 interest when it goes to Moneyclaim.

You can claim the contractual rate of interest at this time but you must leave the statutory 8% until you actually make your court claim.

hi all,sorry i havnt had access to the internet for a while,i sent the first letter off and they have just replyed offering me £700 as full and final,they owe me £1600 all in all.so im now going to send my lba but unsure on what to write at the beginning as i wasnt expecting them to offer me anything,not to sure on how to word it on my letter,if anyones got any ideas i would really appriciate it,thanks.

there is a letter in the templates section called rejection of offer, send that along with your lba!

hi all once again,its now that time for me to make a court claim,think im going to do it on mcol,but i was just wondering its says in step 5 of 8 on the mcol to either tick yes or no to 1.does it include any issues under the human acts right of 1998,not to sure what this means if anyone can help,also on 2.do i want the right to claim intrest, i think i should put yes for this one but really unsure on what to put under the human rights act,if anybody can help it would be much appriciated.

filled in the mcol on the 4th for them to recieve it on the 6/11/06,been checking my claim everyday online and on the 13/11/06 halifax have acknowledge it,guess they have another 14 days in which to do something,do i just sit back now and wait for there move?

Yes. Just wait!

You will probably get a letter from the courts in a day or so with a copy of Halifax's Acknoledgement of Service saying they intend to defend it. This gives them 28 days from the day of service to defend it, which they aren't doing at the mo. I'm a few days ahead of you and am religiously checking my bank account for a nice surprise,non yet though!!

Hi llandegla,well thats not really a good offer but not bad from just sending off your first letter,first of all if you dont decide to take them up on there offer,there is two letter templates you need to send of,first is the rejection of settlement letter and then the letter before action both of these you can find in the templates libery.the letter before action is the last letter you send off before you file a cliam against them.it gives them a last chance if you like, to pay up.there is also a step by step guide you can get in the libery.i stongly recommend reading through this as it gives you a step by step process.if you cant find it il try and send it to you.
