I posted my Letter Before Action yesterday Special Delivery. I am owed £1323.00 in charges and £275.66 in interest at 8%. Cant wait to get a reply.

I had all my statements so didnt have to do any requesting under Data Protection Act. By looking through some other messages people get the same letter sent back to them. At the end of the day im more than happy to invest £100 or so in court fees if it gives me a good chance to get £1500 back.

Default Take action now or wait to clear OD first?

I am about to send the 14 days before action letter for my girlfriends account however she has a overdraft of £1000 thats at the limit. She is asking for £695 back so should she wait untill she has cleared all the OD or put £305 into the bank to bring the OD to £695 or just send the letter now. If we tried we could clear it in about a month.

Just got the standard "computer says no" letter and to read the terms and conditions leaflet enclosed. So on Monday I will be sending in the small claims form and we will see what happens from there.

Default Filling in Small Claims form

Hi im in the process of filling in the small claims form to be posted in (Northern Ireland Court service). I have just about managed to fit in all the info and charges but I read that if I have other information i.e letters receipts etc that I should include them. So should I enclose copies of all my bank statements that have charges on them? probabley about 20 of them.

I have managed to get all the info from the spreadsheet onto the form, Date, days since, interest etc. But im just thinking, what if it goes to court and the judge says show me proof. According to the small claims guide "You may have documents which suport your clam and which you intend to use to prove your case. You MUST submit copies of these with your application form."

Default Halifax Just Paid Up

Hi,

Just got a letter through saying that halifax are paying me the full amount (£1401.00 in fees, 279.52 interest and £62 court fees). I had done the "letter before action", receied the standard reply saying no. I then put a small claim in with the Northern Ireland Courts, they had untill the 14th April to reply.

The letter says they are paying it as it will cost Halifax money to defend it and it would be unlikley they would get these costs back. It also says that if I incur any further charges my account will be closed in 30 days.

Were now going to start action on all the other accounts.

Default New LBA Letter Sent

Just sent a new LBA letter for my girlfriends account £750 in fees plus £35.46 interest. I had mine setteled yesterday (£1742.52) so we shall see if this one takes the same path.
