Default giving them time to investigate?

Hello

I have received a letter after sending a lba
The lba was sent about 2 months after my prelim as havent had a spare minute to go to a post office.

But the letter says that they are allowed 8 weeks to respond, based on their regulator Finance Services Authority, and will let me know anything in the next 4.

As my letter says 14 days do I ignore their letter and continue with my plans or wait?

Also have I made a mess of this because I have sent my lba late??

Do not take any notice of their 8 weeks, you set the time table for now. I would just issue your LBA and then file your claim form 14 days later.

Thank you for your quick reply.

Have I messed up though sending the lba so late after the prelim, not adhering to my letter's own timescales?

Do I let them know that I am ignoring their letter (like they did with my prelim!!) and they have to answer within 14 days not the 8 weeks in order to prevent me putting a claim in?

Thanks for your help

Would not worry, just send your LBA. If you want to change the beginning of the letter to 'I am disappointed you have not responded positively' or similar.

hello

I sent a letter to explain was not prepared to wait and gave them seven days.

I have now received a letter from them offering £495.00 out of the £1200+ they owe me.

They have explained if I do not wish to accept this then to call them within 14 days.

Do I call them and what do I say when I call?

Thanks Andrea

Why are you letting them call the shots STILL?

YOU have given them deadlines. YOU are going to sue them. So no, don't call them, and once you deadline is up, sue them. It doesn't get much simpler.

Andrea, If you feel uncomfortable calling them ... don't.

Just send off the rejection of offer letter from the template section in the Library ... and stick to your timescale remember it's your claim, not theirs.
Don't let them bully you , they're only using scare/stalling tactics.

Stick to your guns

thankyou for your advice. NO I'm not very good with confrontation so I have a fax number on the letter so I will fax and also send them a letter tommorrow accepting part settlement but continuing for remainder.
However, my deadline from the previous letter was up tommorrow.

Do I proceed with the court or give them till Monday, say, to contact me.

Not very good at this am I?
Thank goodness u r all around to hold my hand!!

Thanks Andrea

Its your call, I'd just accept the partial settlement and file in court for the balance.

So what did you put in YOUR letter? Please get back to me if you like, maybe, if you want to, and can get out of bed????

NO! You said in 14 days!!!!!! SO, in 14 days you take the next step which looks like an LBA. Your timetable not theirs take them for everything.

Angie, if you do not know what you are doing you have to read around lots more. You are taking on your bank and this should not be done lightly.

OK

This is an LBA template

3. Letter before action - Consumer version - asking for it back

These are the FAQs that you really, really need to read.

Only once you have read and digested all the info are you really asking questions. Usually it's because people can't be bothered.

Hi

Could you tell me the details of the letter you sent saying you were not prepared to wait. I am in the same position as I have received reply from LBA saying that they are still investigating and should have a response no later than 5 April.
