Default Birmingham Mid/Halifax offered more than claim.

Thought I would post this on here (in case you are missing it).

Myself and others are requesting mortgage charges back from Birmingham Midshires/Halifax. The charges relate to late payment, arrears charges etc. Also separate issues of redemption penalties.

Today I received an offer of £2275 when I had only asked for £2238 and that was from a prelim letter (asking for it back) from the late payment and arrears charges. Also thunderpuss has had a full offer today.

Problem is we do have to sign our lives away to get it. No further action against Halifax/BM/subsiduries etc.

So we can't take it. Each to his own situation but I (we) need to reserve the right to defend ourselves in the future.


Any advice from mods's, anyone. Am I going to lose my case in court if I do not accept their terms for this full payment ( I also need to go after my £1600 redemption penalty). Will the judge look unfavourably at me wanting to keep the right to defend myself in the future?

Filed claim with Moneyclaim 12/07/06
Halifax acknowledged claim 25/7/06
Court papers received 28/7/06 Halifax intend to defend.
HALIFAX SETTLED IN FULL 1/8/06
Donation made
Birmingham Midshire (mortgage charges) Prelim letter sent 2nd Aug 2006, full offer received 11th Aug with conditions.
13th Aug accepted offer unconditionally.
BIRMINGHAM MIDSHIRES (MORTGAGE) SETTLED IN FULL 24/8/06
Sent SurlyBonds template letter to get defaults removed to Birmingham Midshires 27/08/06
DEFAULTS REMOVED 5/09/06.THATS 9 DAYS LATER, YES 9 DAYS
