i was in a similar situation, and did get my offers accepted. I told them i would only deal with them in writing, that i had made an offer, it was in their hands, and i would not accept anything verbally, only in writing.
I also withdrew consent to speak to them over the telephone and advised in writing i would only deal with them through written communication. The usual comments about protection from harassment act, admin. of Justice act also informed them that i knew what i was talking about. I have the odd company that insists on telephoning me, but they get referred to the letters i have written to them.
Obviously you will have sought some professional advice before submitting the token requests. Did you request tha the offer is time-limited with a partial write off of the remaining debt? If it is that there is no equity and no feasible financial resources in the future to pay the debt i would offer the token amount for a set number of years and ask for a partial write off, or a total write off based on the token amount.
If they decline the amount what can they do? take legal action should they so wish, but it is up to a judge then to decide the amount based on your income / expenditure when you submit your defence.
Hope it works out for you, but i would stop answering your telephone, or if you have no choice but to answer the telephone refer them back to your letters and refuse to discuss until you receive a response in writing.

I had the same problems. Always phoning me up.
I took advice from National Debtline and wrote to them "Telling them I was gonig to make token payments" and did so.
Everytime someone phones use the 'broken record technique' "I do not discuss my financial matters over the phone." keep saying this to them to whatever they say.
In my case I went to CCCS and they are administering my DMP. This has worked well apart from GE Money who sold my debt to Asset Link.
However, now I have found this forum I am a lot more confident about dealing with these people in court as they request. |
