Question 7 Day time limit

hello,

Just a quick question really - I haven't managed to find an answer using the search so here's the question...

I am beginning to send of my letters for requesting the refund after recieving some sets of statements. In the letter it states a 7 day time limit for them to reply and I am wondering, is this 7 calendar days like the 40 day Data Protection Act time limit or is it 7 business days?

Please advise!

Also, should I post my progress anywhere, I'm claiming 2 banks, 5 credit cards and 2 store cards

Huh? All the letters here have a 14 day limit, not a 7 day one? And it is generally 14 actual days + a day for delivery, although it is not set in stone.

Keep a record of your progress in the relevant institution.

there are two sets of letters one for non complaince with the Subject Access Request which gives 7 days i believe

the other set is for reclaiming charges and they give 14 days.

If youre asking for your money back you need to use the ones for charges and give 14 days.

I'm using the letters from the govan law centre website (I am in Scotland), and they request a refund within 7 days which I presume I take from the date they recieve and sign for the letter.

I found the Govan Law Centre templates before finding this forum which is why I am using those.

either way is it business days or calendar days?

i suggest you check its calnder days in england and wales i believe generally.

I suppose that leads me to another question then,

As I am based in Scotland, when I am claiming against a bank based in England, do I play by the English rules or still the Scottish ones as that is where I am based?

My bank accounts are in Scottish branches but I have credit card accounts where there is obviously know branch to speak of, so how does it work?

i think it matters which court you use rather than where you live, could be wrong mind.

As an example you could sue a french company in a frecnh court even though you lived in england maybe?

then you would use french rules too.

IIRC, for any letter you send (with the exception of the formal Subject Access Request), there is no specific time window you need to use. The generally accepted guideline is that anything of 7 days or more is reasonable. In general I have allowed 10 days on mine - if you don't get a response to what is essentially a legal threat by day 10 (even having taken the post into consideration), the bank seriously has its priorities wrong.
