Default Data Protection Act

I've sent a standard Data Protection Act letter to Lloyds, they have replied asking for £10.00, which is fair enough, but they also state that their 40 days will start for the time they get the £10.00.

However the DCA website states "Organisations have 40 calendar days to answer your request, counting from the date they receive the request.", it also says they may request payment which suggests that after they have received your request they can then ask for £10.00, it does not say the 40 days starts again.

Anyone know if Lloyuds are right?

It starts from when they get the money.

Looks like quite a few organisations use this as a stalling tactic. You don't send the money, they wait a few weeks, then ask for £10.

Best way to do it, is to send £10 with your letter.
