Default can I claim additional costs?

After reading the forum extensively, I am aware that it is expected that each will pay their own costs to pursue a claim through the county court. Whilst I accept this in principal, can I claim additional costs to help motivate TSB ??

I have currently been waiting 56 days for information under the Data Protection Act. Despite numerous promises it will be delivered, it never does.

The time taken to pursue this request has become considerable, and I feel it only fair for them to cover supplementary costs involved.

Regards, Simon.

Hi Sinon.

Did you send the Data Protection Act SARS letter to get your details, and did you enclose the £10.00 fee ?
If so, they have 40 days to comply, which is up so letter to the Information Commissioner's Office is called for.

Information on the above can be found here.....

Data Protection Act Non-Compliance - Particulars of claim

For Information Commission letter templates click here.....

Data Protection Act - Non-Compliance - Template Letters

If you did not send a Data Protection Act Subject Access Request letter (with £10.00 fee, then DO IT NOW.

Data Protection Act letter can be found here.......

Data Protection Act, Subject Access Request letter - List of charges

While you are waiting for your statements, have a good read of the FAQs. Also the library section contains a lot of info, including step-by-step guide.
Also read the threads in your own bank's forum.
Start your own thread in that section and use it to post any questions and to keep us informed of your progress.

Please bear in mind that you are about to take to court a major financial institution with unlimited funds and an extensive legal department....... it is vitally important that you understand fully what you are doing.
Having said that, if you stick to the well-tried and tested procedures on this site and not go off on a tangent, then YOU WILL WIN.

Good luck.

Hi Rooster,
yes I did send a Subject Access Request letter using a template from this site. I took it to my local branch and insisted on a receipt. I have sent numerous reminders, however despite their promises I have only received some information (twice), but sadly not a list of my charges.

Regards, Simon.
