Default The Role of the Judge

This may be worth a look - sets out what the judge needs to consider and the like. Makes comforting reading for all of us that have received court dates. Not that it will probably get that far - but probably worth a read anyway.

now i know you can walk into a court and have a look around ect but would they give you a guide tour and see how things work now these are busy people with things to do so i have devised a plan in helping me get what i want ie charges back so i have drafted a letter to my local court manager this is what i put

I may in there near future have to make a small claimautolinker.com autolinking image through the County Courts. As I would be representing myself if the matter should escalate to attend Court, I am requesting your permission to attend a small claims hearing. This would benefit me in how Court proceedings work and how to conduct myself.

My intentions are purely for research purposes and as I have never set foot in side a Court let alone a Court room, I would be able to put to rest any fears I would have in case I made a `fool` of myself in front of a Presiding Judge.


so hopefully i will receive a reply with an appointment ie have allocated time to me i will turn up in a shirt tie jacket and hopefully let me sit on a real case that way i will know what to say and what to do. i might even get them to help fill in the n1 claim form i mean it cant be wrong if a judge filled it in!! i will also know what letters will be needed to be filed and when.

i thought this would be a better approach than just walking in and saying can i look around.

as you know from this site you are claiming money from either bank/credit/finance company you have said in your letters that if you dont give it to me i will take you to court. As all the mods have said you may end up going to court. you will be sent letters offering to settle trying to bluff you in not to go to court. they count on this, they count that the fact of walking into court will be to much for some people, this is true i am dreading the thought of having to go and explain my case even though im in the right.

from my thread about you can see i sent a letter to the court asking if i could look around and see how things work. this is the letter i received this morning.

Dear Mr Octron32

Thank you for your letter of 11th August.

All small claimautolinker.com autolinking image hearings are held in public in the Judges rooms. Small claims are not in the list every day. It would be best if you rang the Listing Officer Mr xxxx (or me in his absence) when you know when you want to come to xxxx to listen to a case. He will be able to advise you of a suitable date.
I can arrange for you to be shown around if you just want to familiarise yourself with the court.

I enclose a leaflet called ´Dealing with Debt´and another on ´Making a Claim`which you may find useful.
Call the court when you have decided to issue your claim and we can send you a pack of information and forms to get you started. We have a lot of leaflets that you may find useful as the case progresses.

So one nice letter to the court with a reply of come on down sit in on a hearing and have a look about the place.

For the price of a stamp who could give you more information about going to court than the court itself. (apart from all the mods)
