I have a question. Apologies if this is answered elsewhere, but I didn't find anything similar with my initial search.
We're with First Direct, with an agreed overdraft limit, which we pay for annually. Occasionally, we have exceeded the agreed limit and been charged.
Firstly, I assume that the fee for the agreed limit is legal and cannot be claimed.
Secondly, the charges when we exceeded our limit took 2 parts; first, a fixed £30 excess overdraft fee, and secondly, an overdraft fee of up to £119 which is incremented for each individual transaction made once our account had gone over our agreed limit. They have never refused a payment; just charged us whenever they pay anything out. I assume that all these charges come under the 'unfair charges' heading and can be claimed back?
We pay interest on our debit balance; I believe we can't claim that this is enough to cover their costs so we should be refunded 100% of the charges accrued, and that we may end up having to accept a reduced figure. Is that correct?
Incidentally, the £119 comes from a constraint that charges do not exceed £150 in any given month. It's not all grab, grab, grab with FD, then...

Joking aside, is this £150 significant to our claim?
Sent the Data Protection Act letter off today... I'll post in the appropriate forum when we have any news. This could be a big one... we've dipped into an excess overdraft more times over the last 6 years than I'd like to admit!
