Default Multiple bank charge reclaims ?

Hi,

My claim for bank charge refunds has been on hold since summer 2007. I have been charged nearly £2000 in charges since 1 Jan this year. Can I add these charges to my existing claim, or should I start a 2nd claim ?
I am also thinking of getting my case dealt with due to hardship, is this worhtwhile ? has anyone had any success with this ?

Hi 1stchoice,

Can you tell us if you filed your claim at court ?

If you have it is better to start a second claim, if not, then you can add these new charges to you claim now and get that claim into the court system.

One or two banks have started paying out on Hardship, noteably HBOS.

There is a spreadsheet and letter here :-

Hardship and Stayed Claims

Although the banks have a ongoing test case with OFT there are a number of reasons why you should start claim at court now.

Any older charges (coming up to 6 years) could be lost if you wait for the OFT case to end. Start your claim now and those charges are protected.

When the stays are finally lifted, you will be one of the first in the queue to get paid.

While the banks are protected by the stays, we the consumer, have no such protection and charges continue to mount up.

For some people this may mean going into default. If it is clear that the default was made in respect of charges and that it was lodged after a charges claim was begun then these users have a really excellent chance of having it removed.

Thx, no I haven't started court action yet. I did get a goodwill payment of £700 - out of a claim for £6000 , but I replied that I was not accepting it as settlement and they could have it back. They didn't take it back, but wrote to say I'm on hold subject to the test case.

You can add your latest charges to it and claim the 8% interest at this stage.

You might need to use a spreadsheet to work all this out:-

Also if you have a few claims on the go, it is always advisable to have threads in the appropriate forums, that way you know where you are with each one. And can get the relevant help with each claim.
