Unhappy Hi all...some friendly help if you would :)

Hi....

I've been reading the forums for advice and its been great...but now need advice on something I can't find

HFO (I've read all the problems) are chasing me for a welcome finance debt.

I've done the usual and asked for a CCA and the original agreement, however they are now saying they will not send it to me until I prove who I am as under the Data Protection Act they can't give details out.

Now, they are ringing me several times a day, they've cashed my friends £1.00 cheque and are refusing to send me the CCA because I might not be who they think I am.

I'm refusing to confirm any personal details and have gone down the avenue of if you can't prove I'm the person your looking for then leave me alone

Anybody know what my next step????

Hi Furbykiller, welcome to CAG.
First of all you need to read this, Are you being harrassed on the telephone, & this Telephone harassment - an action plan, these should both help you with the phone calls. Don't forget that you are well within your rights to refuse to answer their questions over the phone, as because you cannot see them, it stands to reason, that you don't know if they're who they say they are. Tell them to send letters from now on, as you refuse to speak to them over the phone; there are some template letters, you could use this one, DCA/Creditor Harassment By Telephone Letter.

Thansk for the advice....

Had another 3 telephone calls today and now they have some how found my work telephone number and are leaving messages to ring them over an IMPORTANT private matter. My boss took me out of a meeting today because he thought it was something to do with a family member

I've told them not to ring me at work ever but thy said they would do so until I either paid the outstanding debt or I faxed them identification over immediatly to prove who I was...

I've sent the letters you mentioned by registered post today (Thanks) but getting a bit worried now about the harrassment at my work telephone number

and more suggestions would be gratefully recieved

Firstly, Hi and welcome to the forum!

Like you said,

If WF are claiming Data Protection Act, in regards to been unsure of who the CCA is sent to, then I'd play with them, and if can't prove your the correct person to send the CCA to, also can't claim you to be the person owing any monies.

At a guess, the cynical side of me is, that WF are hoping you'll send some ID to them, so that can get your personal details and draw up a back dated agreement using your details... but thats just my thinking.

Don't send them any ID. if keep harassing you via telephone send them one of the many templates, DiskManDave's letter is rather good.

Hi all ...

Many thanks for the usefel advice again. Bit of a stange one now though....had a letter through after I hung up the phone on another abusive HFO phone call after telling them I would not talk to them re the above or until they supplied me with a copy of the CCA as requested from then 3 weeks ago.

The letter is from Cattle PLC, the holding company of Welcome Finance? stating that from todays date they have assigned my account to HFO Capital Limited?

Any idea whats this is about or is it just another HFO "standard letter"?

Send them the letter telling them your account is in serious dispute, and under the CCA 1974 your account can not be passed or sold to another party until the original lender/dca who you CCA'd as complied with your request.

In the mean time, simply refuse to confirm your name and postcode when they ring. DO NOT UNDER ANY CIRCUMSTANCES GET INTO A CONVERSATION WITH THEM!

That way they cant continue the phone call.

As they havent complied with your CCA request and are making bizarre requests when it is clear that they know perfectly well who you are, I would pretty much expect that they dont have your credit agreement and are flapping about, hoping you'll be taken in by their nonsense.

What you could do to really piddle on their bonfire is send them a Subject Access Request (and the £10 fee) for every bit of personal data they hold on you, including a call log of all the times they've called you.

When no CCA turns up after 40 days, you'll know you have them by the wotsits and can start having some more fun playing with them- talking harassment claims and claims for refunds of charges, plus interest...

I wouldnt worry about it, but you'll have to put up with the hassle phone calls for a while.
