Default Consumer Credit Act/Charging to apply for a loan

Hi everyone,

Just another little thing i'm getting niggled about, I applied for a loan with Advantage Loans and they said over the phone that I was guaranteed a loan with one of their lenders. I have not been accepted by anyone and this was over a month ago. While I was on the phone i asked if the £49.95 was refundable if I did not receive a loan and they said yes but as I was already guaranteed a loan I wouldn't need to ask for a refund.
I emailed them askeing for a refund and they sent me this in reply

"Dear Mr Schmidlin,
Thank you for your email.
It is regrettable that you feel in any way dissatisfied with any aspect of our service to date. You can write in to our refund team requesting a refund but I do need to make you aware that some lenders may keep your application open for up to 6 months and, in some cases, under the 1974 Consumer Credit Act we cannot refund you until then.
Each application is looked at on its own merit by our refund department. Once they have looked at your request for a refund they will contact you by post within 48 hours.
Your correspondence must be sent to the address as follows:
Advantage Loans
P O Box 4002
Poole
BH14 0BF

As a company we strongly advise that you do get a Guarantor because FLM are the best option for you. Does anybody have any info on this? especially the part about the Consumer Credit Act???? As the payment I made wasn't a credit agreement or anything.

Hi. I've not come across this. It sounds like complete twaddle to me, but i could be wrong.

I would write to the department as they've advised, so that you have followed their complaints procedure. If they still say no, i would contact consumer direct and see what their view is.
