Called Stafford Combined Court today, gentleman I spoke to said the Judge will decide tomorrow on whether to stay or not, but he said it was likely there would be a blanket stay on all cases pending the outcome.

Will call on Thursday and will let you know the outcome.

Stoke on Trent are running on a case by case basis at the moment.

Mansfield County Court have stayed my case, I've appealed and now I have hearing on the 6th November to get the Stay Lifted even though I did ask for one without a hearing.

I've had notification of a stay on my c/card claim with YBank after they requested one - I've written to them & the court & am also going to complain to OFT & FOS as the banks are obviously abusing the system!

Just got back from Peterborough Court and here's what happened.

My claim is actually for default charges on my mortgage account rather than my current account - but the wonderful Abbey put in a defence against a current account claim so i ended up in the same hearing as all the other current account claimants.

Briefly, the DJ said that from now on, as long as the banks requested it, then he would be staying the cases. He also sits in Cambridge court as well and so I presume that Cambridge are doing the same also.

He also stated that he had spoken to the senior judge covering East Anglia (sorry can't remember the exact title) this morning and from what he said it seems that all the courts in East Anglia will be following suit.

He also said that a date has been set in the Commercial Court to hear the test case on January 27th and that 8 consecutive days have been set aside for this case. He spent some time telling people that this was a quite extraordinarily quick timescale for 8 days to be made clear in that court. He went on to say that he wouldn't expect the judge to make a ruling on the case until the end of February - so that they can do all their "consulting" - and that, whichever way it goes, it is expected to be appealled.

While I was there, several people did object to the stay but, I gather, none were successful. I went in after all these other people had been in and the DJ did look distinctly fed up by this stage!

When I was in with the judge, the barrister for Abbey (who, by the way, was a really friendly chap and not at all like some of the other descriptions I've read on here about people's experiences in court) mentioned that he had full details of the Test case and that it very clearly was just in relation to current accounts and that other products such as mortgages, loans and credit cards were not affected. So the judge ordered Abbey to submit a proper defence, set a date for the trial and awarded me costs for my appearance today.


Before the hearing, there was a barrister for Lloyds there and he definitely settled a credit card claim before the hearing. I overheard one Lloyds claimant asking the barrister why the other claim had been settled but not his and the barrister clearly replyed that it was because it was a credit card claim.

Hope this is helpful

Just as a ps, I was speaking to a couple of the barristers afterwards, it seems they had all come up from London (boy this must be costing the banks a fortune). The barrister in my case mentioned that he specialises in defamation in the sports world. They must be really bored out of their minds dealing with these sorts of things instead of what they normally specialise in.

Hastings Court stayed my claim (was due in court next monday - 6 days away!!) although it did offer me the chance to appeal, so will wait to see on that - took all paperwork requesting a removal of the stay down this afternoon (recieved letter this morning)

I just saw your post. Did you attend at court when the stay was requested? If you see my post that I've just done, the DJ would have stayed my case if I hadn't stood up and objected. He also clearly stated that this test case is limited purely to current accounts. I would suggest that you ask to get the stay lifted.

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.
I am Hoping that this list will help in our argument to have stays set aside, by demonstrating to judges that (at the moment) the majority of courts are continuing with claims on a case by case basis, which is a fair and just way to continue.
I also hope to raise the awareness a bit, it may give us all a bit of hope if anyone was fearing the banks letters were right saying all cases were stayed when in fact they werent.
