The HSBC sent us a letter last week saying that they had applied for a stay from the IPswich COunty Court. So far we have heard nothing from the court and hope this bodes well for the case proceeding.

Here is the web page for courts in Scotland which gives phone numbers and locations of sheriff courts

Court Locations

Out of curiosity, I today phoned one court randomly.

This happened to be Dingwall.

The clerk there advised me that cases were proceeding as normal, ie as before announcement of OFT test case. Banks are not defending in all cases, they are in others. Where they are defending, they are requesting sists (stays). These are not automatically granted as the Sheriff will still consider the case on its merits.

I am awaiting feedback from Inverness.

i have an allocation hearing in Kingston-upon-Thames court next Thursday. The court has advised me that they are taking a case by case view on these. I'll let you know how this turns out next week

As far as I am aware Teesside Combined Courts are currently viewing on a case by case circumstance.

At the monent I am at Teesside Combined Courts on the 7th of September.

Will update my main thread accordingly.

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.
I am Hoping that this list will help in our argument to have stays set aside, by demonstrating to judges that (at the moment) the majority of courts are continuing with claims on a case by case basis, which is a fair and just way to continue.
Remember that if your claim is involving a credit card claim, then it should NOT be stayed, and if it is you should appeal this decision immediatly.
I also hope to raise the awareness a bit, it may give us all a bit of hope if anyone was fearing the banks letters were right saying all cases were stayed when in fact they werent.

All the below seem to be playing by a case by case basis and appear to be all proceeding as normal with current account claims, CREDIT CARD CLAIMS ARE STILL AS NORMAL REGARDLESS OF THE TEST CASE:

Don't worry Icy, I realised that hence the above post. We can encourage people to get answers from the Sheriff courts. The above web site has full contact details.

Was coming across quite a few Scottish cases which were not reflected here.

Inverness indicated that no judgement had been handed down to them to grant sists on application and it was down to the sheriff to consider both sides. They have not got a big number of cases.

BODMIN COUNTY COURT
Had a hearing date for 10th September. I applied to the court last week to refuse a stay if asked for. I have had no reply. My court bundle has to be in by 24th August, I just rang the court The girl who spoke to me said that every case in the country was being stayed, I said that in many courts the cases were still being heard. She said that they had been instructed by the senior judge of Devon and Cornwall to stay every case, so it seems that Bodmin, Truro, Plymouth Exeter Torbay and Barnstaple are not hearing cases.
She acknowledged that my application had been received by the judge but but did not know whether he had made a decision.

Problem now is do I waste time and money getting the court bundle in by 24th or not, if I dont will I be penalised for not getting in on time.

I think I would tend to carry on with your bundle as when the OFT win the case all your docments will be already on file and at this late stage it would be a shame if the banks were given a loop hole to get your case struck out..
