When works change salaries, do you have to be given this in writing? if so how much notice?
I work for a major national company, and following a pay structure change all roles within our centre were to be on a similair pay scale and the monthly sales related bonus was to be replaced with an Annual bonus based on your yearly performance. For those that obtained bonus for 6 months or more in the previous year, they would get a transitionary payment of 50% Sept, 25% Nov and 25% in March 2007 based on average of bonus in that previous year.
My department did not get a monthly bonus based on sales as the work we do was outside the scope of normal sales so instead we had an average bonus paid with our salary, of which we received letters confirming "
your new basic salary will be £XXX". There was no mention of bonus in the letters.
When the change roll out meetings came, a few of us questioned this with the Union and managers. Managers said we had bonus incorprated with our pay so would have a pay reduction (loss of bonus) and get the transitionary payments, The Union rep (Amicus) contacted HR and an agreement was made with the Directors of Bonus and HR that we should be given the option of the transition payment or to retain our higher salary.
Management on the other hand were not happy that the union were involved or contacted regarding this so according to them went to the 'legal dept' who confirmed we dont have to be paid any transition payments at all and that it was a goodwill gesture, which after a delay of 6 weeks already many of us accepted in the end.
To date, we have still not had letters confirming our new pay salary, and were not given any notice in writing of the proposed change reduction.
Can anyone shed some light on the legalities of this?
