There is a section within the consumer credit act 1974
section 25.2 (d)
which can be applied for complaints.
here is the wording;

d) engaged in business practices appearing to the Director to be deceitful or
oppressive, or otherwise unfair or improper (whether unlawful or not).

Telewest Broadband.......Won ..after 2 bounced cheques and them running out of time.
Barclays Business;.1 won Round 2 limitation hearing.DEC 08
Citi Cards.Stayed;Stay lifted -hearing FEB09
Default removals;Rbs stayed
Virgin media; Judgement by default.
Vanquis;Looking for the hidden charges !

the Director probably owns the company and sanctions these actions ....

Probably, but the director must be seen to be acting with the utmost integrity and will obviously have no knowledge of what his hoodlum employees are up to!!

According to Company Law, a director must see that the practices of his business are within the Law and that the employees of the business must act within the Law at all times. If an employee is seen acting outside the law, while working for the company, the Director can ultimately be held responsible. Almost impossible to prove, however!!

yes, but in reality we know they support these actions.

obviously, they are well aware of how their business is run.

i agree they may not know that an employee has gone 'overboard' with some comments, but overall they do know most of what an employee would say.

I believe "Director" refers to the Director-General of the OFT.

I think this refers to D-G of OFT too. Presumably the yardstick is whether the DCA has breached the OFT Debt Collection Guidelines by acting unfairly etc.. as most of them do!!

Yes your observation is correct.
Unfair practices can cover a multitude of things too.
