Default Damage to car - Car Park

A feww months ago I damaged my car in the car park of a large hotel whilst i was attending a course. I didn't know at the time but found out afterwards that this car park is renowned for accidents as it is wery tight. I asked to speak to a manager who dismissed my claim out of hand. However, i have since found out from a colleague who stayed at this hotel that tehy were warned about this car park when they checked into the hotel. Therfore the hotel are aware of the problems with this car park. I going to get a few estimates for the repairs and writing to the hotel requesting the least expensive. If the hotel refuse to give me the money does anyone know if i can take them to the small claims court?

In short, I don;t know.

But if you have tried to negotiate in writing with the hotel, then personally the small claims court would be my next step.

Get all bills/estimates in duplicate you never know if the hotel will 'mislay' them!

Was it you who damaged your own car or was it damaged by someone else.

If it was you who collided with something I think you've very little chance of claiming off the hotel unless you can find them negligent in some way.

Yes it was me who damaged the car, my question is because the hotel know that the car park is very tight and actually warn people when they are checking in are they therefore negligent?

Personally I don't think you have any rightful claim against the hotel. (I may be wrong).

They may have been negligent had they failed to warn you.

You may possibly have a claim because they know there is an issue with the car park!

You need to find out what actions they have taken to resolve the issues with the car park.

A judge may find that they are partially liable if they have taken no rectification actions
