Default Threatening letter from Hitachi Cap

Hope this is in the correct section, please feel free to move if not.

Please can someone can help me here?

I have received a letter from Hitachi Cap saying they are going to send a representative round to see what the problem is with my not being able to afford the full payments each month for an item i purchased. They also want to charge me £84 quid for the privilige. I was made redundent at Christmas so the payments had to be decreased accordingly. I did write to tell them of my circumtances but seems they are takin no notice. Can i ask them not to come round or refuse them entry? Also can i refuse to accept the charge they want to make for reps visit? Will they charge me this even if the rep doesn't come to my house due to my refusal?

Really worried about all this as all these fees they keep adding is getting out of hand and this rep things just looks like another way of making money from someone who hasn't got any.

Is there a letter i could send to stop them? Or do i just have to accept this visit and the charge?

Thanks any help is much appreciated.

The £84 is excesive and you shouldn't have to pay it but how much are you paying and how much should you be paying?

I am in the process or reclaiming Late Payment fees from Hitachi Cap, they will be issued with Court Papers next week if they don't respond!!!

Personally I would claim in the same way as the banking forum and declare that the account is in dispute untill they repay their unlawful charges.

Thank you so much for your replies and advice. I have given you a little more background into the situation incase it might help..

The payments should have been £350 for 6 months after the 12 months, buy now pay later thing ran out. I took out Payment Protection Insurance when i purchased the item, which added an extra £200 odd to the bill. The first payment to come out for the item should have been this January gone but was made redundent in December so could only afford a £40 token payment at the time. They told me i couldn't make use of the Payment Protection as i hadn't paid the full £350 payment for the first month. Thought this was a bit odd as if someone is made redundant just before the payments start, how are they suppozed to be able to afford the first payment? I thought the whole idea of PPI was to cover for these unexpected circumstances.

Anyway i wrote a letter explaining my situation and phoned many times but still they passed me onto DCA and are now giving me 7 days to either pay the full amount or a Rep will be coming round to see me about the problem. I have continued to pay the £40's each month but this is the most i can afford on Incapacity Benefit. Hitachi are ruthless and have harrassed me so much that i am actually treating them like a priority debt, when i should be paying my Gas bill, which is far more important, but can't afford both. I would never have ordered the item in the first place if it wern't for the fact that i thought i had job security, (worked there 8 years an no hint of closure until the last month).

I didn't know I could try and claim the £84 back as i though this fee for the rep visit was classed as a service. Would be interested to know if it is a penalty fee or service charge, if it is the former then i will try to claim it back. They have added a couple of hundred quid on top so far also because i havnt paid the full instalment amounts.

I would have a scoot around for information about misselling of Payment Protection Plans. It's worth a try whilst your on their case.

Usually the likes of Hitachi Cap will charge for this in the capital and then apply interest to the premium. I would check your Credit agreement, they may not have kept to their end of the bargain by not providing this service for which they are giving you credit and given you further grounds to complain.

I would talk to CAB in your circumstances as you should not feel forced into a situation where you are compromising on essential spending to cover a debt with an aggressive creditor.

Keep me informed on how you get on, I found that taking these guys on was a life changing experience I hope you find it the same.
