Hey Guys,

Just wondering if this book only applies for England county courts, or can it be helpful for Scottish Sheriff Court small claims?

No, it's not applicable North of the border as the legal systems are different. Hopefully the following might give you some guidance though?

The procedure in Scotland is different to that in England. England has County Courts, whereas Scotland has Sheriff’s courts. Whereas in England you submit your claim on an N1 form, in Scotland you submit it on one of three forms, depending on the value of your claim:

Under £750 – small claim
£750 - £1,500 – summary cause claim
Over £1,500 – ordinary cause claim

The claim form can be collected from any Sheriff’s Court or can be requested by phone.

The form will come with a helpful and easy to understand booklet which will explain the procedure. The fee payable to the Court on issue is £39 which you’d add to your claim of course! This fee can be waived if you are on benefits or your wage is particularly low but you’ll need to complete a fee exemption application form which can be downloaded from:
