Hi there

Has anybody had any dealings with P&C finance?

I have been purchasing a car through there finance have missed some payments and they are now chasing me for an additional £923.80 in charges.

Can they do this?

Nope, they can't. Not unless the charges actually represent a true reflection if their costs incured through your breach of contract.

Have you finished paying for it if not how long does it have to run?

They DO NOT care about the rules & they don't want to know.

I warn you now this firm is very very aggressive & you MUST be prepared to challenge them in court.

I owe £525.25 balance and title transfer and £921.89 in other charges.

Hi

Its been a while since I lasted posted here but I am finally trying to sort myself out.

I owe Private & Commercial = £1447.04

which is made up as follows:

£525.25 oustanding payments inclusive of title transfer

£921.89 other charges

They have sent me a statement and it is for unpaid dd's, default etc.

I called them tonight to negotiate paying the £525.25 off and that I felt the charges were unfair.

They told me they would be able to write off a couple of hundred from the charges but that is it.

Do you know were I stand and do these operate the same way as banks

They can charge you those prices...but only if they can prove that it actually cost them that much to process your unpaid debits, defaults, etc. Now, unless they send you letters written in gold ink by magical goblins working on an hourly rate of £100 and one firstborn child per month, I'd say it can't cost them more than £3 to send out a letter, process a bounced direct debit, etc.
Charges cannot be punitive, ie there to punish you for not sticking to the terms of the contract. They can only reflect what those breaches actually cost the company.

As Dave says, no they can't. Start the process in a similar way to a bank charges reclaim, and as JonCris says you will probably need to take them to court.

Pay off the £525. 25p balance as soon as you can then send your S.A.R - (Subject Access Request) & when its confirmed they have imposed unlawful penalty charges that's the time to enter into a dispute.

oh my god i cant beleive their are other people who havehad dealings with these dreadfull people we now have a £6,000 charging order on our house because of these people we arranged to return the vehicle to them and as i understand from cab because we had paid over a third and voluteraly returned it we owe them nothing but they have got two different solictors involved two different county courts and kept going until they got their order there seems theres nothing in this world we can do any advice would be so much appreciated i am at a loss it is a very very long story
but any help please

They have a charging order sorry but your going to have to explain how it's got that far without your defending it

How did you return the car. did you make arrangements or just dump it What reason if any did they give for issuing proceedings when they knew you had paid 1/3 also what do you mean by 2 solicitors. What happened to the 1st one

ok very long story but try to cut it short nearly three years agp we traded the jeep in for our current vehicle with the same garage after we tried to return voluntarily the garage didant pay off the finance and college credit as it was called then pursued us so we told them where the vehicle was at the local garage they then vacated the county court application stating their reason as vehicle returned we have had no correspondance from anyone untill march this year when eived another county court application stating they wanted the outstanding balance plus 16 months interest i really didant know what to do half the paperwork was mislaid and filed we couldnt get any info where the vehicle was how it was disposed of where it was sold who bought it beleive me we went everywhere they applied through a different court different name no longer college credit private and com i gave up hope to be honest then i found some old paperwork quite by chance a copy of the log book saying we traded it into the garage, a copy of the voluntary termination after they had obtained their order we received a letter asking us to pay our outstanding amount which is different than the amount they went to court for we did get it transfered back to taunton and one judge questioned there seemed to be two actions for the same thing but no onone seems to be able to help us i have tried solictor cab nothing makes any sense but i just dont know what to do i dont want to plead poverty but weve got two disabled boys and i know this sounds bad but i just dont know what to do

we tried to return but they didant pick it up so the garage said they would pay off rest of finance and resell the jeep to get their money back plus and signed the log book i have a copy of this but the garage didant pay finance so when a company working for college credit came to our door we told them where the jeep was and they took it from the garage
