Angry Demands to pay mail order Co. sig on delivery was NOT mine.

I ordered an item from a mail order company, which never arrived. When I disputed this, I was aksed to submit a copy of my signature as their courier company say the item was delivered safely. I did and have now received a letter and a copy of the signature used (which in no way resembles mine!!) to say that the charge remains as a signature was obtained on delivery, even though I offered to submit a timesheet from my employer, to prove I could not have been home at the time the alleged delivery was made (they clearly don't bother to read the letters sent!) and that my signature has been used fraudulantly (anyone with partial eyesight can see the one they have is no where near mine. Can anyone help me with where I stand legally?

Hi Saffie,

Is it possible anyone was there to sign when you were out.

Have you asked if any neighbours have signed and taken a package in.

You'll have to write to the MO Co and say it is their responsibility to ensure the package was properly delivered to your home. Leaving anything with a neighbour is not acceptable (sad reflection of our society). They instructed the courier and the courier is clearly responsible.

As it's clear the signature they have is not yours, they must assume the package was delivered incorrectly and send you a new item. Tell them to make sure the courier WILL NOT leave anything at a neighbours address.

BTW, I think you were unwise to send them a specimen signature - they could have been less honest and said the signatures match.

Hi Slick,

No possibility anyone else was at home (unless one of my cats has learned to write!)

They usually leave a card if an item was left with a neighbour, and there was definately nothing posted.

The only way they would investigate the issue was if I sent them a copy of my signature - whatever happened to the customer is always right? They are also legally obliged to send me a copy of the signature obtained. While I appreciate, they may have to deal with less honest people, I have offered to supply them with proof that I could not have signed for the item.

The signature they have supplied looks nothing mine, which they clearly haven't bothered to look at - I'm left handed and have a very distinctive slant to my writing, this one is nowhere near mine. I think I have a battle on my hands!
