Default Help with faulty lease car please

Hi, I am really hoping someone is able to help. I am leasing a brand new 2008 Mitsubishi Outlander (got it beginning of May 200 for 3 years. After 1 week I was broken down on the motorway after the turbo pipe came off. The jubilee clip was replaced and everything seemed ok. Last night (so 4 weeks later) driving home on the motorway the same thing happend and we were repaired at the side of the road. 5 miles down the road the SAME thing happend again!!! This time we were recovered home. I managed to get a courtesy car for 48 hours and the car went to the garage for repair today. This seems to be a known fault. However, even if they can repair it I am not sure I ever want to drive it again!! I have spoken to the leasing company about swapping to a different car (this one is clearly not fit for purpose) but they said to cancel the contract would incur huge penalties (up to 50% outstanding costs). I said that I have no problem with their contract or their lenders contract but wanted to move the finance to a different car - they said this is not possible. Is this right, do I have any other options? Or will I just be stuck with this car, living in fear that it will happen again, for the next 3 years? As a woman doing a lot of motorway driving on my own I do not relish this prospect. SOrry this is long, hope you can help.

I think that to be fair, you need to let them perform the repair and give them the opportunity to fix it fully. If it is properly repaired it is highly unlikely generally taht it would ever re-occur. With regards the legality, I am unsure, as you have not and are not purchasing the car - this MAY have implications on your rights under the SOGA.

Hi shamalamb

Welcome to CAG. I'm not sure if this is the best location for your question as it is a leasing question (the fact that it is car is not necessarily the most important point). I will leave it here for a day or two and see who reponds. Otherwise I will see if I can find a better location.

Maybe, but leases arent my "bag" steven, so may need to end up being moved anyway to be honest - I've pretty much said all I know on the subject!

You need to examine your lease carefully, terms and what service they are providing. It is a service you are receiving not purchasing avehicle.
You may even have to consult a sloicitor.
