Is there anybody out there who has had trouble with the above company in relation to cancelling agreements with them where letters posted unrecorded to them are said by the company to have not arrived like our letter and cancellation slips posted first class and denied ever recieved by the above company based in glasgow. One of there customer service advisors let slip that our cancellation letter and slips had arrived at the company which has since been denied since legal action to cancel our agreements has been put on the company by our solicitor. This company seem quite happy to use deception in order to get money off of innocent customers who try to cancel agreements with them any feedback about this company to do with cancellation problems or anything you think might help our case will be gratefully recieved as the company needs exposing for the terrible way they do buisness and try to block cancellation of agreements by any means ie producing false letters , suppressing first letters and slips of cancellation and lying about statements made in phone calls to the company.

This one of the main reasons this forum continually says to subscribers - Do not telephone, use recorded delivery.
Because of Royal Mails poor reputation, they will take advantage of it to deny having received.

Are you cancelling an agreement in mid session or during the cooling off period?

We tried to cancel during the cooling off period and the company gave us five days only to return cancellation slips to there office in glasgow. The cancellation form said nothing about sending recorded delivery so we posted them the same day first class. We have two witnesses proof of postage the company in phone call at first claimed that our cancellation slips had arrived but late past there cancellation period which is unlikely as the postal service usually delivers letters first class within two to three days. The company refused to cancel claiming we first contacted them after the cancellation period and they were clever to not write that our first contact was by letter. Later when we put legal action against them to help us cancel they claimed our first contact was a telephone call and our first letter had not arrived. They denied that there customer service advisor whos name I did not get had told us that our cancellation letter and slips had arrived.

Has anybody out there had any dealings with the above company based in glasgow where they have denied that your letters posted first class to them have not been recieved? We have had this letter denial problem with this finance company and have had to engage a solicitor to try to cancel our agreements even though the company admited in telephone call that our cancellation letter and slips had arrived. Any feedback about denied letters could help our ongoing case so please dont hesitate to contact us about this dishonest company who will lie to get money from innocent people.

Hi Forensics,

I am new to this forum and thought i must registar becuase i am going through nearly the same situation as you with these sharks! I sent a cancellation letter to them because i had changed my mind about a course i was going to take with Home Learning College, to point out i had done this well with in the date of the cancellation period. I phoned them a couple of days later and they said that my letter never arrived. I said to them i sent it through the post on the 23rd May but they still denied it ever arriving, they then went on to being really unhelpful, saying that i should have sent the letter recorded delivery. I pointed out to them that it doesn't say that on their pink slip you sign and i hadn't received any other details about cancelling the agreement by then. (I received this a few weeks later with the date of me signing the agreement which wouldn't have been possible and the letter wasn't on headed paper)

I wrote to them providing different bit's of evidence, i printed out my propertise of when the letter was created and i sent the letter through work so there is a record of a letter going out but it doesn't state what and who to, but for some reason they are still not excepting this as proof!!

I'm not sure what else i can do. We have been down to the citizens advise bureau but they don't seem to be able to help me

Any thoughs would be great

I apologise in advance if folks don't find this relevant...

However, some of you CAGers out there might be interested to know that Clydesdale fob a lot of their purchase agreements for home learning college, dixons, karen millen etc on to our buddies at Experto Credite. Back when I was working there we had to say we were "Francis calling from Clydesdale."

All too often we would get the people we were chasing saying they had cancelled an agreement well within the period. You will be even less surprised to know that Experto and Clydesdale do not communicate too well
