Yesterday I bought a new mountain bike (with extra lock and lights) and a child's trailer from a local bike shop. The idea was I could stick the kids in the trailer, tow them to school and lose a few pounds into the deal.
Anyway, this morning I dropped the little girl off as planned and was
pushing the bike out of the school when one of the wheels fell off the trailer. Obviously fuming (as I'd just cycled down the main road [they're okay for road use] and had visions of what would have happened if the wheel had fallen off then) I pushed the bike and trailer to the shop and - as no manager was available - left everything with them until I can speak with someone.
However, before I speak with them, can someone give me some advice please?
- If I return the trailer under sale of goods act (as I think its unsafe /not of satisfactory quality and not fit for purpose) can I also return the bike? There's nothing wrong with the bike (other than it CONSTANTLY loses teeth and the chain keeps falling off!) but I only bought it so I could pull the trailer!
- I paid on a credit card and the total came to £165, but each of the items were under £100 - am I covered under section 75?
Obviously the quality/fit for purpose argument is going to be of some debate but to my mind, just because the trailer doesn't
have to be safety marked like bikes it doesn't make the design safe - and wheels that can fall off during use (apparently its designed to be "quick release" so it "can happen") are unsafe, especially as the trailer is sold as fit for road use?
It'll be a fun discussion when I go back down there I'm sure.
Any help would be greatly appreciated.
