1. Damaged goods in the remit of
Section 1(2A) of the Sale and Supply of Goods Act 1994 are not considered fit for the purpose they are intended.
2. They have also failed to deliver some of the goods according to contract and you can ask for a refund under
Section 11 of the The Consumer Protection (Distance Selling) Regulations 2000.
I can see a catch-22, these measures might not get your money back this side of christmas. If you paid by card, ask your bank for a chargeback. If you paid by credit card and the transaction is more than £100 then
Section 75 of the Consumer Credit Act is your route.
If in doubt, always use a credit card.
