Default xbox 360 broke- replacement advice

Well ive had my xbox 360 since launch and today ive just got the three red lights. I no under the new warrenty microsoft has started I can return it to them and have it repaired for free. But I do not think it is acceptable to wait about a month for it to get back to me.
Ive still got the receipt and I am wondering if I got any chance against game to return it for a replacement/refund the product. It should be expected to last for more than 22 months, also this fault has been there since it has been manufactured and is also very very common (just google three red lights and see what posts you can find). So can anyone help me with this? Have I got a case with Game?

Replacement/refund not a chance, an xbox 360 99% of the time after 1-2 months will be a repair.
Game are within their rights to send it off to microsoft to be repaired, and as microsoft tell retailers to do this after 22 months it is doubtful they will do something else.
The 3 lights is there to show the console is not operational and not exactly what is wrong with it, this should be displayed on the screen as an error code. Microsoft will pick it up, and deliver it back and tbh one of the best manufacturers I have seen at fixing their own goods.

I no Game are within their rights to repair it but as far as I no Game will not repair it. They will either give a replacement/refund. What I am asking is if I have a chance or not in getting either one of them
