Default Is it Illegal for a garage to sell a car without MOT

Hi,

I bought a car 6 months ago and was told that the car would be MOT'd for 12 months before I collected it.

I never got the certificate and have been chasing them since, they have now admitted that they didnt MOT it.

My question is, what laws have they broke by supplying me with a car with no MOT and telling me it was.

Its certainly illegal to use it on the road without one, and if that was part of the contract for the sale they should of provided one.
Take it back and ask them to MOT it there and then! and they should then be liable for any repairs if it fails.

It's not illegal in general to sell a car with no MOT, but it is illegal to give a false description. So in this particular case it was illegal.

Can you tell who sold you the car ?-specifically I mean was it an individual (private sale) a sole trader/ dealer Franchised dealer or what ?
I think I know the answer but am asking as its not been stated.

If you bought the car from an advertisement where did you see it ?

I think seasoned peeps here will know why I am asking.

It was from a franchised dealer. I cant say who it was obviously because they will be getting a complaint soon from me.

basically, one of the conditions agreed when buying the car was that it would be MOT'd for 12 months as it ran out about a week before I collected the car.

I wasnt given the certificate when i picked it up because the service dept was closed as it was at night so I kept ringing about it and was told that the car was MOT'd and that they would post the cert to me. Then after badgering them enough they admitted that something had gone wrong somewhere and it had been overlooked
