paid for repairs that have not been done

hi

i broke down outside a garage as the clutch fork had broke. i went in for there assistance where they told me it was the clutch fork and the gearbox had to come out, anyway they phoned me later saying it needs a new clutch kit as well. so i agreed, may as well while the gearbox is out. they charged me over £600 all in all. the only thing they didnt change was the clutch cable. saying it didnt need replacing and something i should think about in 6 months. all was fine for a few days but then it started to cruntch going into 3rd gear. decided to buy a clutch cable and go local to my home(only whent to other garage as thats where i broke down) to have it fitted. the second garage refused to fit the cable saying i need a new pressure plate. i explained about the gearbox but the mechanic at the second garage assured me the gearbox has never been removed or had any work eccept a new clutch fork. the 1st garage say they did the work and to prove them wrong.
ok so now i cant touch the gearbox or have anywork done to it until i prove the original work has not been done.

can any one tell me how i can prove this?
should a pressure plate come as part of a clutch kit?
and can a clutch fork be fitted without the gearbox being dismantled?

the van is a citroen berlingo diesel on a 54 plate.

Not much you can do except get an engineers report on the work to prove what has/not been done and then take them to court.
You can always write and tell them that is what you intend to do and see if they respond?
have you detailed receipt of work, time , parts etc. if not ask for one without letting know it may be used against them.
ask them for old parts

yes i have a detailed bill. time part etc. will ask for old parts tomorrow. i have already argued with them so i expect them to have thrown them away by now, if there was any. going to talk to the AA, they may be able to help.

Get the AA to go and look, also take photos.
Yes the pressure plate is part of the clutch kit.
In most cars no, but some including your citroen have a different design, they have an external arm and an internal rod/fork, the external arm(that I think your calling the fork)can be changed without removing the box, the internal rod and fork cannot.
If the second garage are sure the gearbox has not been removed, then the first garage could not have changed the clutch kit.

ok.yje garage have given me the money back and apologized. they said it was a mix up with a simular van they had in the same week.

Its great and uplifting to hear you got it refunded. I have a very similar issue (propably worse case) with Mr Clutch in Northampton, basicly, they didnt change my clutch that they charged me for. and I am about to post a thread in here to see any response.
